RESOLUTION APPROVING THE REVISED APPRAISAL OF
PARCEL #63 FOP. THE HOLLIDAY CREEK CHANNEL
IMPROVEMENT PROJECT , RE-SETTING JUST COMPENSATION,
AND AUTHORIZING PURCHASE OR CONDEMNATION.
WHEREAS , on February 4 , 1986 , the City Council approved
Resolution No . 14-86 which accepted the appraisal of seven parcels
of real property for the Holliday Creek Channel Improvement
Project; and,
WHEREAS, the appraisal for Parcel #63 was for a 6 . 90 acre
tract in Lot 1, Parish Brothers Addition; and,
WHEREAS, 1 .44 acres out of that 6 .90 acres had previously
been dedicated as drainage easements in Volume 345 , Pages 260 and
262 of the Deed Records of Wichita County, Texas; and,
WHEREAS , the appraisal for Parcel #63 has now been revised
by Henderson Appraisals and Consultants Company to delete the
previously dedicated easement and adjust the fair market value
accordingly.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS , TEXAS, THAT :
SECTION 1 . The legal description of the drainage easement
to be acquired is as follows :
Parcel #63
A 5 . 46 acre tract in Lot 1, Parish Brothers Addition, as
fully described by metes and bounds in a field survey prepared by
Brannon Engineering, Inc . , on January 13, 1986 .
SECTION 2 . The amount of just compensation is to be set at
33, 300 .00 , which is also the fair market value as determined by
Henderson Appraisals and Consultants Company, who was employed to
appraise the property for the City of Wichita Falls . A copy of
said appraisal is on file in the City ' s Property Management Office .
SECTION 3 . The City Manager is hereby authorized to acquire
a drainage easement on Parcel #63 , as described above, in the name
of the City of Wichita Falls .
SECTION 4 . In the event that the City Manager is unable to
purchase this easement for the appraised value, he is authorized
to increase the offer when, in his judgment, it appears to be in
the best interest of the City to do so to save the cost of condemna-
tion. If both parties are unable to agree upon a value for the
property, the City Manager is hereby authorized and directed to
cause to be instituted condemnation proceedings to obtain such
property in the name of the City of Wichita Falls for the Holliday
Creek Channel Improvement Project.
