Res 016-86 2/4/1986RESOLUTION NO. /(l- RESOLUTION AUTHORIZING EXECUTION OF DEED CONVEYING THE LITTLEST SKYSCRAPER COMPLEX TO WICHITA COUNTY HERITAGE SOCIETY. WHEREAS, the City of Wichita Falls has heretofore acquired the title to the following described land situated in Wichita Falls , Wichita County, Texas, to-wit : The west 33-1/3 feet of Lot No. 1, Block 162 of the Original Town of Wichita Falls, being the same property conveyed in a deed from Iva Deanne Pink to Guy E. Mathews, Jr . , et ux, recorded in Volume 1114 , Page 136 of the Deed Records of Wichita County, Texas . This property is known as the Littlest Skyscraper Complex. WHEREAS , this property was acquired by the City for historic site preservation purposes, and the Wichita County Heritage Society, a non-profit corporation, desires to obtain this property from the City so that they may operate, maintain and preserve this historic site for the benefit of the public ; and, WHEREAS, the City Council finds that the purpose for which the property was acquired can best be served by conveying it to such Heritage Society. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS , THAT: The City Manager is hereby authorized and directed to execute for the City of Wichita Falls a deed, without warranty, conveying the above-described property to the Wichita County Heritage Society, subject to the following terms and conditions : 1 . The property shall be operated, maintained and preserved as a historic property for the benefit of the public . 2 . The conveyance shall be subject to the terms of the judgment dated February 17 , 1978 in Cause No . C-130-A in the 30th District Court of Wichita County, Texas . 3 . Such deed shall contain a provision that in the event that the Heritage Society should ever dissolve or become inactive, or in the event of the failure of the Heritage Society to operate, maintain and preserve such property as a historic property for the benefit of the public, or in the event the Heritage Society should violate any of the terms of the judgment in Cause No. C-130-A, then the deed and all rights, title and interest conveyed to such Society may be cancelled and voided by ordinance duly passed by the City Council of the City of Wichita Falls , and upon the passage of such ordinance and the filing of a certified copy thereof in the deed records of the County Clerk's office of Wichita County, Texas, all right, title and interest in and to said property shall revert to and vest in the City of Wichita Falls.
