Res 014-86 2/4/1986r RESOLUTION NO. /2/—& RESOLUTION APPROVING THE APPRAISAL OF PARCELS 1 , #4 , #5 , #7 , #7-A, #9 , AND #63 FOR THE HOLLIDAY CREEK CHANNEL IMPROVEMENT PROJECT, SETTING JUST COMPENSATION, AND AUTHORIZING PURCHASE OR CONDEMNA- TION. WHEREAS , it is necessary to acquire drainage easements on the hereinafter described property, known as Parcels #1, #4 , #5, #7 , 7-A, #9 , and #63 , for the excavation of Holliday Creek; and, WHEREAS, such property has been appraised by an independent appraiser employed by the City of Wichita Falls , and the appraisals have been reviewed by the Property Administrator and are now on file in the Property Management Office . NOW, THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS , TEXAS , THAT: SECTION 1 . The legal descriptions of the drainage easements to be acquired are as follows : Parcel #1 A 4 .13 acre tract in Block 4 , Irrigation Subdivision of the John A. Scott Survey No . 13 , Abstract 303, as fully described by metes and bounds in a field survey prepared by Brannon Engineering, Inc . , on November 9 , 1985 . Parcel #4 A 2 .75 acre tract in the John A. Scott Survey 12 , Abstract 296 , as fully described by metes and bounds in a field survey prepared by Brannon Engineering, Inc . , on December 14 , 1985 . Parcel #5 A 0 .98 acre tract in the John A. Scott Survey 12 , Abstract 296 , as fully described by metes and bounds in a field survey prepared by Brannon Engineering, Inc . , on December 14 , 1985 . Parcel #7 A 0 .05 acre tract in Lots 10 and 11, W.T . Milliron Addition, as fully described by metes and bounds in a revised field survey prepared by Brannon Engineering, Inc . , on January 11, 1986 . Parcel #7-A A 0 .0007 acre tract in Lot 12, W.T . Milliron Addition, as fully described by metes and bounds in a field survey prepared by Brannon Engineering, Inc . , on December 14 , 1985 . Parcel #9 A 0 . 35 acre tract in the John A. Scott Survey 12, Abstract 296 , as fully described by metes and bounds in a field survey prepared by Brannon Engineering, Inc . , on December 14 , 1985 . Parcel #63 A 6 .90 acre tract in Lot 1 , Parish Brothers Addition, as fully described by metes and bounds in a field survey prepared by Brannon Engineering, Inc . , on January 13, 1986 . SECTION 2 . The amount of just compensation is to be set as follows : Parcel #1 3, 100 . Parcel #7-A 50 . Parcel #4 3 , 100 . Parcel #9 3, 050 . Parcel #5 1,100 . Parcel #63 36 , 100 . Parcel #7 2 , 144 . The above-stated amounts of just compensation are also the fair market value determined by a real estate appraiser employed by the City of Wichita Falls . The City Manager is hereby authorized to acquire a drainage easement on Parcels #1, #4 , #5, #7 , #7-A, #9 , and #63, as described above, in the name of the City of Wichita Falls . 2 - SECTION 3 . In the event that the City Manager is unable to purchase such parcels for the appraised value, he is authorized to increase the offer when, in his judgment, it appears to be in the best interest of the City to do so to save the cost of condemnation. If both parties are unable to agree upon a value for the property, the City Manager is hereby authorized and directed to cause to be instituted condemnation proceedings to obtain such property in the name of the City of Wichita Falls for the Holliday Creek Channel Improvement Project .
