RESOLUTION APPROVING THE APPRAISAL OF PARCELS
70 , #71, AND #72 FOR THE HOLLIDAY CREEK CHANNEL
IMPROVEMENI' PROJECT, SETTING JUST COMPENSATION, AND
AUTHORIZING PURCHASE OR CONDEMNATION.
WHEREAS, it is necessary to acquire the hereinafter described
property, known as Parcels #70 , #71, and #72 , for the excavation
of Holliday Creek; and,
WHEREAS , such property has been appraised by an independent
appraiser employed by the City of Wichita Falls , and the appraisal
has been reviewed by the Property Administrator and is now on file
in the Property Management Office .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS , TEXAS, THAT:
SECTION 1 . The legal descriptions of the right-of-way parcels
to be acquired in fee simple title are as follows :
Parcel No . 70
Lot 3, Tract 1, Holliday Tracts, Block 1-A, of
John A. Scott Survey No . 7
Parcel No . 71
Lot 2 , Tract 1, Holliday Tracts, Block 1-A, of
John A. Scott Survey No . 7
Parcel No . 72
Lot 1, Tract 1, Holliday Tracts, Block 1-A, of
John A. Scott Survey No . 7
SECTION 2 . The amount of just compensation for Parcels 70 ,
71, and 72 is set at $38 , 333 .00 , which is also the fair market
value determined by a real estate appraiser employed by the City
of Wichita Falls. The City Manager is hereby authorized to acquire
the above-described parcels in fee simple title in the name of the
City of Wichita Falls .
SECTION 3 . In the event that the City Manager is unable to
purchase such parcels for the appraised value, he is authorized to
increase the offer when, in his judgment, it appears to be in the
best interest of the City to do so to save the cost of condemnation.
If both parties are unable to agree on a value for the property,
the City Manager is hereby authorized and directed to cause to be
instituted condemnation proceedings to obtain such property in
the name of the City of Wichita Falls for the Holliday Creek Channel
Improvement Project.
