Ord 121-83 9/20/1983 ORDINANCE NO 121-83 ORDINANCE AMENDING SECTION 32-21 OF THE CODE OF ORDINANCES, TO REQUIRE A DEPOSIT FOR ALL PERSONS AND BUSINESSES DESIRING TO USE CITY WATER WHEREAS, the average water, sewer, and refuse bill has increased substantially over preceding years; and, WHEREAS, the deposit is now substantially less than the estimated amount of a two month bill . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS THAT: Section 32-1 of the Code of Ordinances is hereby amended to read as follows: "(a) All persons desiring to use City water shall make a money deposit with the Utility Collection Division. The amount of said deposit shall be a reasonable sum to protect the City from loss due to unpaid bills and shall not substantially exceed the estimated amount of a two month bill and in no case shall be less than $50.00 for each service connection. (b) Deposits for duplex, apartments, mobile home parks, and any other master metered multi -family residential area shall be thirty dollars ($30.00) for each apartment unit or occupiable space and shall not substantially exceed the estimated amount of a two (2) month bill and in no case shall be less than $60.00. (c) Business and commercial deposits shall be a reasonable sum not substantially exceeding the estimated amount of a two (2) month bill and in no case shall be less than fifty dollars ($50.00) • (d) No person 65 years of age or older who is a customer in good standing shall be required to make a money deposit for his primary residence if he submits to Utility Collection Division satsfactory proof of his age. (e) In order to be a customer in good standing, the customer must not have: (1) allowed his City utilities bill to have become delinquent more than three times within the preceeding twelve month period; or (2) attempted payment of his City utilities bill more than one time in the preceding twelve month period with a check that was not honored by the bank. (f) A customer shall lose his exemption for the deposit requirement if he fails to maintain his good standing, and he shall immediately be responsible for depositing the proper amount. The deposit requirment shall continue until the customer reestablished his good standing. (g) Any person 65 years of age or older, who now has a money deposit with the Utility Collection Division, will have his deposit refunded to him if he is customer in good standing, and he files an application for such refund, with satisfoctory proof of his age, to the Utility Collection Division and such application is approved by the Utility Collection Manager."
