Ord 135-83 11/1/1983 ORDINANCE NO. /15-13 AN ORDINANCE CLOSING, VACATING, AND ABANDONING A PORTION OF A UTILITY EASEMENT RETAINED BY ORDINANCE 97-83, IN CANFIELD'S SUBDIVISION OF BLOCK 263, ORIGINAL TOWNSITE, WICHITA FALLS, TEXAS WHEREAS, the Planning Board of the City of Wichita Falls has recommended the closure of a portion of a utility easement retained by Ordinance 97-83 in Canfield's Subdivision of Block 263, Original Townsite, Wichita Falls, Texas; and, WHEREAS, the City Council of the City of Wichita Falls, Texas deems it advisable and in the public interest to close, vacate, and abandon a portion of the easement hereafter described. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS THAT: The portion of an easement retained by Ordinance 97-83 in Canfield's Subdivision of Block 263, Original Townsite, Wichita Falls, Texas more specifically described as follows: A tract of land out of the J.A. Scott Survey No. 6, Wichita County, Texas, said tract being more specifically described as being a parcel of land lying along the north line of the alley located in Canfield's Subdivision, said subdivision being part of the City of Wichita Falls, Texas; said tract being that portion of the original alley which has been closed by action of City Ordinance No. 97-83 with the retention of the original 20 foot width as a utility easement; the herein des- cribed tract being a portion of said 20 foot utility easement which is to be closed as a utility easement; said tract being described as follows: BEGINNING at the southeast corner of Lot 1 of the above mentioned Canfield's Subdivision; thence South 55 deg 11 min West along the south line of the above mentioned Lot 1 and the north line of the original alley, presently designated as a 20 foot wide utility ease- ment, a distance of 40 feet to the most easterly corner of the herein described tract, and the Place of Beginning of this description; THENCE South 55 deg 11 min West along the north of said original alley, a distance of 332.5 feet to the southwest corner of Lot 9 of the aforementioned Canfield's Subdivision; thence South 34 deg 49 min East a distance of 3 feet; thence North 54 deg 40 min East a distance of 332.51 feet to the Place of Beginning; be and the same is hereby closed, vacated, and abandoned. -2- PASSED AND APPROVED THIS THE 1st day of November, 1983.
