ORDINANCE GRANTING WAIVER OF SECTION 2 OF ORDINANCE
NO. 2763 (SECTION 2301 .11 OF THE BUILDING CODE) FOR
THE PURPOSE OF CONSTRUCTING A SUBDIVISION IDENTIFI-
CATION SIGN ON THE MEDIAN OF HOMEWARD WAY.
WHEREAS, Section 2301 .11 of the Building Code prohibits signs
on public right-of-way, with certain exceptions such as useful
directional information signs; and,
WHEREAS, the Edgecliff Homeowners Association has requested
a waiver of this section in order that a subdivision identification
sign may be constructed on the median of Homeward Way, the entrance
to the Edgecliff Subdivision; and,
WHEREAS, the City Council finds that the circumstances involved
in this situation are exceptional, that the approval of such subdivision
sign will aid in subdivision identification and will beautify the area,
and that a waiver of said Section 2301 .11 should be granted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
The requirements of Section 2301.11 of the Building Code are
hereby waived to allow the Edgecliff Homeowners Association to construct
a subdivision identification sign on the median on Homeward Way.
The location of the sign must be approved by the Director of Traffic
and Transportation, and the sign shall not exceed two and one-half
(2-1/2) feet in heighth. If at any time in the future the City Council
determines that the public interest requires that such sign be
re-located or removed, it shall be so re-located or removed at
the sole expense of the Edgecliff Homeowners Association.
