Ord 139-83 11/1/1983 ORDINANCE NO. /J —f3 ORDINANCE GRANTING WAIVER OF SECTION 4-26 OF THE CODE OF ORDINANCES TO ALLOW SALE OF ALCOHOLIC BEVERAGES AT 1625 ARCHER CITY HIGHWAY. WHEREAS, the Fraternal Order of Eagles owns a tract of land at 1625 Archer City Highway within the City limits, and they have a dancehall license on the building on such property; and, WHEREAS, they formerly had a beer and wine permit at this location, which they dropped, but they now desire to apply for a new beer and wine permit; and, WHEREAS, the City has condemned a part of their property in order to extend Professional Drive; this condemnation reduced their highway frontage on Archer City Highway to approximately 15 feet, which is so small and is so located that a curb cut is not allowed, and therefore the property does not qualify for an alcoholic beverage permit under the City ordinance; and, WHEREAS, the Fraternal Order of Eagles , which is a non-profit organization whose members work strictly for charity supporting crippled and retarded children, heart and cancer funds and elderly people, has requested that Section 4-26 be waived in this case so that their property will be considered abutting the Archer City Highway, and eligible for an alcoholic beverage permit; and, WHEREAS , the City Council considers this to be an exceptional situation, and such waiver should be granted. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The provision of Section 4-26 of the Code of Ordinances, as construed by the City staff, requiring that the property abut the qualified street, is hereby waived, so that the Fraternal Order of Eagles shall be authorized to obtain a beer and wine permit at such location.
