ORDINANCE WAIVING ORDINANCE NO. 105-83 , TO ALLOW
KOURI 'S SUPERMARKET TO QUALIFY FOR AN OFF-PREMISE
ALCOHOLIC BEVERAGE LICENSE WITHOUT THE REQUIRED
100% SIGNATURES .
WHEREAS, Ordinance No . 105-83 authorizes the sale of certain
alcoholic beverages for off-premise consumption, if all owners of
residential property within three hundred (300) feet of the place
of business sign a waiver of such requirement; and,
WHEREAS, Kouri ' s Supermarket, located at 1800 Hayes Street,
has requested a waiver of such ordinance, so that they will qualify
for such sale if 0 % of the owners of residential property
within 300 feet of their place of business waive such requirement;
and,
WHEREAS, the City Council finds that the circumstances involved
in this matter are exceptional, and the waiver should be granted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS , TEXAS, THAT:
Such requirements of Ordinance No . 105-83 are waived with
regard to Kouri ' s Supermarket, so that the sale of vinous liquors ,
malt liquors and beer in unbroken original containers may be sold
to consumers for off-premise consumption, if ifel % of the owners
of residential property within 300 feet of such place of business
sign a waiver of such requirement.
