AN ORDINANCE CLOSING, VACATING AND ABANDONING A PORTION OF A
TEN (10) FOOT WIDE UTILITY EASEMENT IN LOT 40, MCKENZIE REPLAT
OF BLOCK 8 AND PART OF BLOCKS 7 AND 9, AN ADDITION TO THE CITY
OF WICHITA FALLS, TEXAS
WHEREAS, the Planning Board of the City of Wichita Falls has recommended
that a portion of a ten (10) foot utility easement be closed, vacated, and abandoned,
said easement lying in Lot 40, McKenzie Replat of Block 8 and Part of Blocks 7 and
9, an addition to the City of Wichita Falls, Texas; and,
WHEREAS, the City Council of the City of Wichita Falls, Texas deems it
advisable and in the public interest to close, vacate, and abandon the easement
hereafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF WICHITA FALLS, TEXAS, THAT:
That portion of the ten (10) foot wide utility easement in Lot 40,
McKenzie Replat of Block 8 and Part of Blocks 7 and 9, being more specifically
described as follows:
BEGINNING at the southeast corner of said lot, said point also lying in
the north right-of-way line of P.B. Lane, a dedicated street;
THENCE North 89° 16' West along the south line of said Lot 40 a distance
of 115.73 feet to a point in said south line;
THENCE North 01° 46' East 10 feet to a point in the west lot line of
Lot 40;
THENCE leaving said point South 89° 16' East a distance of 115.73 feet
to a point in the east lot line of Lot 40;
THENCE leaving said point South 01° 46' West along 10 feet to the place
of beginning;
be and the same is hereby closed, vacated and abandoned.
