Ord 146-83 11/15/1983 f • • ORDINANCE NO. 146-83 AN ORDINANCE AMENDING ARTICLE II OF CHAPTER 4 OF THE CODE OF ORDINANCES CHANGING THE METHOD OF MEASURING DISTANCES BETWEEN ALCOHOLIC BEVERAGE DEALERS AND RESIDENCES AND CHANGING THE PERCENTAGE OF OWNERS OF RESIDENTIAL PROPERTY REQUIRED TO SIGN A WAIVER NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Section 4-18.1 of Article II of Chapter 4 of the Code of Ordinances is hereby amended to read as follows: "Section 4-18.1. Sale for Off-Premise Consumption of Alcoholic Beverages (Unbroken Original Containers) in Other Locations. The sale of vinous liquors, malt liquors and beer in unbroken original containers, to consumers for off-premise consumption is authorized in any place of business where more than seventy (70) percent of its gross revenue is derived from the sale of grocery products other than alcoholic beverages. Such places of business shall be located not less than three hundred (300) feet of any church, school, hospital or residence; the measurement to be in accordance with Section 4-24 (a) below, in the case of a church or hospital, and in accordance with Section 4-24 (b) below in the case of a school. The measurement in case of a residence shall be along the property lines of the street fronts and from front door to front door, and in a direct line across intersections. The word "residence" in this Section shall mean any single family residence or multi-family residence. However, the requirement that any such place of business shall be located more than three hundred (300) feet of any residence shall not be applicable if 100% of the owners of resi- dential property within such three hundred (300) foot distance, sign a waiver of such requirement. Such a place of business shall not advertise on any exterior sign the fact that it sells alcoholic beverages. The owner or operator of every place of business which sells alcoholic beverages under this Section shall submit to the City Clerk quarterly, on or before the 30th day following the end of each calendar quarter, a sworn statement showing the total amount of its gross revenues for the preceding quarter, and the amount of its gross revenues realized from the sale of grocery products not derived from the sale of alcoholic beverages during such quarter. In addition, the City Clerk or any person designated by the City Clerk shall have the right to examine the books and records of any such place of business. Anyone failing to file such state- ment, or who files a false statement, shall have his license revoked, and shall be ineligible to apply for a similar license in Wichita Falls for a period of twelve (12) months." - -2- SECTION 2. Section 4-19.1 of Article II of Chapter 4 of the Code of Ordinances is hereby amended to read as follows: "SECTION 4-19.1. Sales in restaurants in other locations. The sale for consumption on the premises where sold of vinous and malt liquors and beers, containing not more than fourteen (14) per cent of alcohol by volume, is authorized in any restaurant which is located not less than three hundred (300) feet of any church, school, hospital or residence, the measurement to be in accordance with Section 4-24(a) below, in the case of a church or hospital, and in accordance with Section 4-24(b) below in the case of a school. The measurement in case of a residence shall be along the property lines of the street fronts and from front door to front door, and in a direct line across intersections. Such a restaurant shall not advertise on any sign (except on the menu) the fact that it sells alcoholic beverages.
