Ord 149-83 12/6/1983 ORDINANCE NO. #9._ AN ORDINANCE CLOSING, VACATING, AND ABANDONING A FIFTEEN (15) FOOT WIDE UTILITY EASEMENT IN LOT 1, BLOCK 20, MIDWESTERN PARK, AN ADDITION TO THE CITY OF WICHITA FALLS, TEXAS WHEREAS, the Planning Board of the City of Wichita Falls has recommended that the fifteen (15) foot wide "Y" shaped utility easement in Lot 1, Block 20 of Midwestern Park, an addition to the City of Wichita Falls, Texas, be closed, vacated, and abandoned; and, WHEREAS, the City Council of the City of Wichita Falls, Texas deems it advisable and in the public interest to close, vacate, and abandon the utility ease- ment hereafter described. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The fifteen (15) foot wide utility easement in Lot 1, Block 20 Midwestern Park, more specifically described as follows: BEGINNING at a 1/2" iron rod set at the intersection of the east right- of-way line of Maplewood Avenue and the south right-of-way line of the north part of Plaza Parkway, for the northwest corner of said Lot 1, Block 20, Midwestern Park; THENCE South 82° 19' East, a distance of 302.81 feet to a point at the intersection of a line 10 feet south and parallel to the south right-of- way line of the north part of Plaza Parkway and the centerline of a 10" sanitary sewer line for the place of beginning of this description; THENCE along the centerline of the herein described easement that is to be closed and extending 7.5 feet either side of said centerline; SEGMENT NO. 1 THENCE South 38° 28' East, along said centerline, a distance of 101.49 feet to the centerline of a manhole point "A"; THENCE South 38° 45' East, along said centerline, a distance of 325.47 feet to the intersection of a line 10 feet North and parallel to the north right-of-way line of the south part of Plaza Parkway and the centerline of said 10" sanitary sewer line for the end of said Segment No. 1 of this easement closure; r t. . _ -2- SEGMENT NO. 2 BEGINNING at said point "A", the centerline of a manhole; THENCE North 55° 39' 30" East, along said centerline passing a manhole point "B" at 97.6 feet, a total distance of 137.95 feet to the intersec- tion of a line 10 feet south and parallel to the south right-of-way line of the north part of Plaza Parkway and the centerline of an 8" sanitary sewer line for the end of said Segment No. 2 of this easement closure; SEGMENT NO. 3 BEGINNING at said point "B" the centerline of a manhole; THENCE North 00° 32' East, along said centerline, a distance of 23.07 feet to the intersection of a line 10 feet south and parallel to the south right-of-way line of the north part of Plaza Parkway and the centerline of an 8" sanitary sewer line for the end of said Segment No. 3 of this easement closure. be and the same is hereby closed, vacated and abandoned. SECTION 2. This ordinance shall become effective upon the relocation of the existing sewer lines in the said easements at the cost of the developer, and as required by the Director of Public Utilities.
