AN ORDINANCE CLOSING, VACATING, AND ABANDONING A TWENTY (20)
FOOT WIDE UTILITY EASEMENT IN LOT 2, SAFEWAY ADDITION NO. 1,
AN ADDITION TO THE CITY OF WICHITA FALLS
WHEREAS, the existing twenty (20) foot wide utility easement across the
northwest corner of Lot 2, Safeway Addition, No. 1 is no longer required by the
City; and,
WHEREAS, the City Council of the City of Wichita Falls deems it advisable
and in the public interest to close, vacate, and abandon the easement hereafter
described.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
SECTION 1. The twenty (20) foot wide utility easement more specifically
described as follows:
BEING a 20.0 foot wide utility easement across Lot 2, Safeway Addition
No. 1, being a portion of the easement recorded in Volume 332, page
376, Wichita County Deed Records, also being 10.0 feet either side of
the following described centerline:
BEGINNING at a point in the Westerly line of Lot 2, Safeway Addition
No. 1, said point being N 34° 09' W, 325.95 feet from the Northerly right-
of-way of Fifth Street;
THENCE N 20° 50' W, 206.50 feet to a point in the Northerly line of
said Lot 2.
be and the same is hereby closed, vacated, and abandoned.
SECTION 2. This easement closure does not in any manner affect the status
of any other existing private or public easements on this lot which intersects or
has any common area within said easement being closed.
SECTION 3. This ordinance shall become effective upon the abandonment
of the existing water line by the developer, as required by the Director of Public
Utilities.
