ORDINANCE AMENDING CHAPTER 7 , ARTICLE II, SEC. 7-15
BY THE ADDITION OF SUBSECTION 15 . 4 TO PROVIDE FOR
REGULATION OF ADVERTISING BENCHES.
WHEREAS, it is the desire of the City of Wichita Falls to
preserve the public health, safety, and general welfare of its
citizens; and,
WHEREAS, advertising benches gather refuse, paper, and dirt,
which tend to endanger the public health and foster the spread of
fires; and,
WHEREAS , advertising benches obstruct the vision of drivers,
thereby creating a traffic menace; and,
WHEREAS, regulation of advertising benches is necessary to
prevent obstruction of public view near street lines, public high-
ways, public roadways, and public places; and,
WHEREAS, it is in the interest of the public welfare to reduce
the overall number of outdoor advertising displays, thereby reducing
the number of aesthetic eyesores along the streets and highways of
the City; and,
WHEREAS, sufficient alternative forms of outdoor advertising
displays, as well as radio, television and newspaper advertising are
available to protect the advertiser' s constitutional guarantee to
freedom of speech and equal protection under the law:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:

(15. 4) Chapter XXIII , Signs and Outdoor Displays, is amended
by adding Section 2301. 14 , which shall read as follows :
"Section 2301.14 - Bench Advertising.
Paragraph 1. In addition to the provisions of 2303 . 1 relating
to the construction requirements of ground signs and all other
applicable provisions of this Code, no advertising bench shall be
currently maintained or hereafter placed until a permit is obtained
from the Building Official upon application of the person, firm, or
corporation wishing to maintain or place said bench, and a permit
fee of $10 . 00 paid for each bench. The provisions of Sections
2301 .3 and 2303 . 1 (b) of this Chapter shall not apply to advertising
benches.
Paragraph 2 . Any off-premise advertising bench erected or
placed before December 6 , 1977 , which does not comply with Section
2303 . 1 of this Chapter by March 7 , 1989, is subject to immediate
permit revocation.
Paragraph 3 . Each application for permit shall be filed with
the Building Official, on a form furnished for that purpose, and
shall contain the following:
(a) Name , business address, mailing address and phone
number of the current advertisers;
(b) Proposed location of the advertising bench;
(c) Signed, written consent of the property owner on
whose property the advertising bench is to be located along with
the mailing address and phone number of said owner.
Paragraph 4 . Every advertising bench currently maintained
or hereafter placed shall be plainly marked with the name of the
person, firm or corporation erecting or maintaining such sign and
shall have affixed on the front thereof the permit number issued
for said advertising bench by the Building Official.
Paragraph 5 . No more than one (1) permit shall be issued for
any one intersection.
Paragraph 6 . In addition to the provisions of Section 2301.8
of this Chapter, any property owner on whose property an unpermitted
bench is located may file a written request with the Building
Official or his agent asking that the bench be removed from said
property. Upon receipt thereof, the unpermitted bench shall be
subject to immediate removal by the City without notice to the owner
or lessee thereof. Any such advertising bench removed pursuant
to this section may be redeemed by the owner or lessee thereof
by the payment to the City of $50 . 00 for costs incurred in removing
any such advertising bench to a place of storage and an additional
$1. 00 per day for costs of storage. Any advertising bench not
redeemed within sixty (60) days after removal shall be considered
abandoned and may be destroyed.
