Ord 016-84 2/21/1984 ORDINANCE NO. / _f4t ORDINANCE AMENDING SECTION 8-61 AND ADDING SECTIONS 8-64 AND 8-65 TO THE CODE OF ORDINANCES OF THE CITY OF WICHITA FALLS TO PROVIDE FOR DISPOSITION OF PRO- HIBITED WEAPONS AND PERISHABLE GOODS COMING INTO THE CUSTODY OF THE POLICE DEPARTMENT . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Section 8-61 of the Code of Ordinances is hereby amended to read as follows: Sec. 8-61. Unclaimed property - Reports, content. All personal property, except as specially provided in Section 8-64 and Section 8-65 of this Code and live animals, not owned or claimed by the City, in possession, custody, or under control of any City department, City official, or City employee, and which shall have remained unclaimed by the owner thereof for at least sixty (60) days or on which any fees, charges, or penalties claimed by the City have not been paid by the owner for at least sixty (60) days shall be reported by the department, official, or employee having such possession, custody, or control to the City Manager immediately after the expiration of such period of sixty (60) days. Such report shall be under oath and shall show: (1) When (giving the date) and how said property came into the posesssion of such department, official or employee; the name or description and the estimated value thereof. (2) The name and address, if known, of the owner or claimant thereof. (3) The amount of the cost of storage or care of said property and all other expenses in connection with the keeping and preservation or impounding thereof, including any other fees, charges, or penalties claimed by the City. SECTION 2 . Section 8-64 is hereby added to the Code of Ordinances. Said Section shall read as follows : Section 8-64 . Prohibited weapon; procedure for disposition. (a) Any pistol, dirk, dagger, illegal knife, slingshot or any weapon prohibited by the Texas Penal Code which comes into the possession of the Police Department during the course and scope of said Department' s duties which is not being held as evidence for use in trials or pending cases or which has not been ordered returned to the person entitled to possession of such item by a court of competent jurisdiction, which for a period of not less than sixty (60) days has remained unidentified or unclaimed by the lawful owner after notice to such owner, or if the lawful owner cannot be determined, shall be destroyed in the presence of three (3) police officers, and said officers shall file a written report under oath listing the type, make, model and serial number, if any, of the item destroyed, together with the time, date, place and manner of destruction. (b) It is provided, however, that abandoned pistols which the Chief of Police or his designated representative has deter- , mined to be serviceable may be transferred to the permanent City equipment inventory of the Wichita Falls Police Department for usage by said Department in the daily course of its business as if such pistols had been originally purchased by the City of Wichita Falls for that purpose. (c) It is also provided that in the case of abandoned pistols which have been classified as antiques or collectors ' items by a qualified expert in the firearms field, such pistol shall be disposed of pursuant to Section 8-61, et. seq. regarding unclaimed and abandoned property. The Chief of Police or his designated representative shall determine and select such qualified expert in the firearms field to classify such pistols. (d) Any unclaimed firearm or pistol may be sold to a firearms dealer, licensed by the U. S . Treasury, Bureau of Alcohol, Tobacco, and Firearms , under the Federal Firearms Act. Such dealer must possess such license as required to receive and deal in firearms of the type to be sold, and sale will be by sealed bid. (e) For the purposes of this section, notice shall mean a letter mailed to the last known address of the owner of such property by certified mail, describing the property being held, giving the name and address of the officer holding such property, and stating that if the owner does not claim such property within thirty (30) days from the date of the notice, such property will be sold or destroyed. t. .. SECTION 3 . Section 8-65 is hereby added to the Code of Ordinances. Said Section shall read as follows : Section 8-65. Perishable Property and Goods; procedures for disposition. (a) Any and all perishable property or goods which deteriorate rapidly in value and utility which come into the possession of the Police Department during the course and scope of said Department' s duties shall be disposed of by said Department as follows: The Police Department shall make a good faith effort to identify, locate and give personal notice to the lawful owner of such property. In the event the Police Department is unable to determine in a timely manner the lawful owner of such property, said Department shall dispose of such property in a commercially reasonable manner, or, if necessary, shall dispose of same in a sanitary fashion consistent with applicable health statutes or ordinances. (b) For the purpose of this ordinance, commercially reasonable manner means the sale of property to a business, restaurant, or commercial concern. SECTION 4 . Emergency. This ordinance is declared to be an emergency measure on the ground of urgent public need for the preservation of the peace, health, and safety of property of the City, and it shall become effective on its passage.
