AN ORDINANCE WAIVING SECTION 9L(4) , APPENDIX A, CODE OF ORDINANCES
(COMPREHENSIVE SUBDIVISION ORDINANCE NO. 2118) TO ALLOW A LOT WITH-
OUT PUBLIC STREET FRONTAGE TO BE PLATTED FOR PROPOSED LOT 3, BLOCK
1, HIGHLAND ADDITION, WICHITA FALLS, TEXAS
WHEREAS, the Planning Board has recommended that Lot 3, Block 1, Highland
Addition be platted without public street frontage subject to the recording of three
(3) access easements, and obtaining another non-designated access easement; and,
WHEREAS, the City Council of the City of Wichita Falls, Texas finds that
the circumstances in the situation of the platting of Lot 3, Block 1, Highland
Addition is exceptional, and deems it advisable and in the public interest to waive
the ordinance hereafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
Section 9L(4) , Appendix A, Code of Ordinances (Comprehensive Subdivision
Ordinance No. 2118) requiring lots to have public street frontage is hereby waived
for Lot 3, Block 1, Highland Addition, Wichita Falls, Texas, subject to the follow-
ing conditions:
1. The recording of the three access easements with the County Clerk.
2. The obtaining of a non-designated access easement which will exit on
Kell Blvd. at the northeast part of Parker Square.
3. The construction of the three easements taking place during construc-
tion of the first phase of the apartment complex.
4. Construction of a drainage system both on and off premise that would
satisfactorily handle the problem.
S. That provisions be made for on premise pedestrian traffic being tied
into existing off premise sidewalks.
