AN ORDINANCE AMENDING CHAPTER 28, TAXATION, OF THE CODE OF ORDINANCES,
CITY OF WICHITA FALLS, TEXAS, BY ADDING ARTICLE III PERTAINING TO TAX
FREEZE FOR HISTORIC PRESERVATION; PROVIDING A SEVERABILITY CLAUSE; AND
DECLARING AN EMERGENCY
WHEREAS, Section 11.24 of the Texas Tax Code provides local governments
with the authority to abate ad valorem taxes as incentive for historic preservation.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
SECTION 1. Chapter 28, Taxation, of the Code of Ordinances, City of
Wichita Falls, Texas is hereby amended by adding "Article III, Tax Freeze for Historic
Preservation" to read as follows:
"ARTICLE III. TAX FREEZE FOR HISTORIC PRESERVATION
Sec. 28-30 Historic Landmark Tax Freeze. The City Council may by ordinance,
approve a tax freeze on both land and structure on eligible historic landmarks, which
the City Council determines is in need of tax relief to encourage its preservation.
The qualifying historic landmark will be taxed on an annual assessed value equal to
the assessed value on the tax year immediately before the rehabilitation was commenced,
for eight (8) years following completion of the rehabilitation project. The tax
freeze will begin the first day of the first tax year after verification of the
rehabilitation by the Design Review Commission.
Sec. 28-31 Eligibility for Tax Freeze. To be eligible for a city property
tax freeze, the property must be designated a local historic landmark by the City
Council or be contained within a locally designated historic district, and meet all
of the following conditions:
a. The cost of the rehabilitation project must exceed fifty (50) percent
of the assessed valuation of the structure for the year the rehabilitation is to
begin or one hundred thousand (100,000) dollars, whichever is less. Only that
rehabilitation for which a building permit, electrical permit, or plumbing permit
has been issued may be counted in determining whether the work exceeds the minimum
project cost requirement.

b. The plans and proposals for the rehabilitation project must be
approved by the Design Review Commission of the City of Wichita Falls.
c. The historic landmark must not have been granted a previous property
tax freeze under this article.
d. The rehabilitation project must begin within six (6) months from
the passage of a tax freeze ordinance for an individual rehabilitation project.
Sec. 28-32 Historic Landmark Destruction or Alteration.
a. Where the City Council determines that a historic landmark is
totally or partially destroyed or altered by the willful act or negligence of the
owner or his representative, the owner shall immediately repay to the City all of
the tax revenues that were not paid because of the tax freeze.
b. Where the historic landmark is totally or partially destroyed or
altered other than by the willful act or negligence of the owner or his representa-
tive, the owner shall, within sixty (60) days request a demolition permit when
reconstruction is not feasible, or request a building permit to reconstruct or
repair the historic landmark upon receiving approval of the reconstruction or repair
plans from the Design Review Commission."
SECTION 2. The provisions of this ordinance are severable. If any pro-
vision of this ordinance or the application thereof to any person or circumstances
are held to be invalid or unconstitutional, the remainder of this ordinance shall
nevertheless be valid.
SECTION 3. There exists a public emergency requiring that this ordinance
shall take effect immediately upon its passage.
