RESOLUTION APPROVING THE APPRAISAL OF PARCELS
48 AND #49 FOR THE HOLLIDAY CREEK CHANNEL
IMPROVEMENT PROJECT, SETTING JUST COMPENSATION,
AND AUTHORIZING PURCHASE OR CONDEMNATION.
WHEREAS , it is necessary to acquire a drainage and utility
easement to the hereinafter described property known as Parcels
48 and #49 for the excavation of Holliday Creek; and,
WHEREAS , such property has been appraised by an independent
appraiser employed by the City of Wichita Falls, and the appraisals
have been reviewed by the Property Administrator and are now on
file in the Property Management Office.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS , TEXAS, THAT:
SECTION 1 . It is necessary that the City of Wichita Falls
acquire the hereinafter described property for drainage and utility
easements for the Holliday Creek Channel Improvement Project:
Parcels #48 and #49
A 3 .219 acre tract of land in Blocks 1 and
2 of Kiwanis Park Subdivision out of Blocks
3 and 6 , J . A. Scott Survey, Abstract 302 ,
Wichita County, Texas, as described by metes
and bounds in a field survey prepared by
Biggs & Mathews, Inc . , on May 28 , 1986 .
SECTION 2 . The amount of just compensation for Parcels #48
and #49 is to be set at $23, 435 .00 , which is also the fair market
value determined by a real estate appraiser employed by the City
of Wichita Falls . The City Manager is hereby authorized to acquire
a drainage and utility easement on Parcels #48 and #49 , as described
above, in the name of the City of Wichita Falls.
SECTION 3 . In the event that the City Manager is unable to
purchase such parcels for the appraised value, he is authorized to
increase the offer when, in his judgment, it appears to be in the
best interest of the City to do so to save the cost of condemnation.
If both parties are unable to agree upon a value for the property,
the City Manager is hereby authorized and directed to cause to be
instituted condemnation proceedings to obtain such property in the
name of the City of Wichita Falls for the Holliday Creek Channel
Improvement Project.
