RESOLUTION DETERMINING NECESSITY FOR ACQUISITION
OF A UTILITY EASEMENT IN HIGHLAND ADDITION,
APPROVING THE APPRAISAL, SETTING JUST COMPENSATION,
AND AUTHORIZING PURCHASE OR CONDEMNATION.
WHEREAS, it has been determined by the Property Management
Division that a utility easement is required in the Highland
Addition to cover the existing sewer force main; and,
WHEREAS, the property has been appraised by an independent
appraiser, and such appraisal has been reviewed by the Property
Administrator and is now on file in the Property Management
Office.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. It is necessary that the City of Wichita Falls
acquire a utility easement on the hereinafter described property
to cover the location of the existing sewer force main.
SECTION 2. The legal description of centerline of the 15 '
wide utility easement to be acquired is as follows:
BEGINNING at the northeast corner of
Lot 1, Block 164, replat of Highland
Addition;
THENCE South 47° 54 ' East 162 feet
across Block 119 to a point on the
south line of Block 119 and the North
side of Avenue U, which is the end
of this easement.
SECTION 3 . The amount of the just compensation is to be set
at $2,916. 00, which is also the fair market value determined,by, a
real estate appraiser employed by the City of Wichita Falls. The
City Manager is hereby authorized to acquire utility easement
rights on this tract, as described above, in the name of the City
of Wichita Falls.
SECTION 4. In the event that the City Manager is unable to
purchase such easement for the appraised value, he is authorized
to increase the offer when, in his judgment, it appears to be in
the best interest of the City to do so to save the cost of

condemnation. If both parties are unable to agree upon a value
for the property, the City Manager is hereby authorized and
directed to cause to be instituted condemnation proceedings to
obtain such property in the name of the City of Wichita Falls.
