RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE A RELEASE OF A SANITARY SEWER EASEMENT
TO MIDWESTERN STATE UNIVERSITY.
WHEREAS, in 1975, by Senate Bill No. 1008, the Texas Board
of Mental Health and Mental Retardation conveyed an easement to
the City of Wichita Falls for a sanitary sewer main; and,
WHEREAS, said sewer main, known as the "Wichita Falls State
Hospital Sanitary Sewer Main" , had been located in the John A.
Scott Surveys Numbers 8 and 9, and Blocks 1 and 2 of the Kemp and
Newby Subdivision of the Cherokee County School Lands for many
years; and,
WHEREAS, an additional easement was required in 1986 from
Midwestern State University in order to make major repairs to a
section of the line; and,
WHEREAS, it was agreed that the City of Wichita Falls would
release the portion of the original easement on the land now
owned by Midwestern State University if a new easement was
executed by the University. Such easement has now been conveyed
and was recorded in Volume 1467, Page 323 of the Wichita County
deed records.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The City Manager is hereby authorized to execute and deliver
a release of a portion of the sanitary sewer easement authorized
by Senate Bill No. 1008 and recorded in Volume 1467, Page 67 of
the Wichita County deed records. Said portion to be released is
located in Wichita Falls, Wichita County, Texas, and being
further described as follows:
BEGINNING at a point where the sanitary
sewer main crosses the East property
line of the Wichita Falls State Hospital,
being also a point in the West boundary
of Block 1 of the Kemp and Newby
Subdivision of the Cherokee County School
Lands, said place of beginning lies
3, 212 feet South from the Northwest
corner of said Block 1;
THENCE South 79° 30 ' East 9.7 feet to
the start of the 10 ' wide easement to
be closed;
THENCE South 41° 25 ' West 5.8 feet to a
point;
THENCE South 79° 30 ' East 144. 9 feet to
a point;
THENCE North 24° 08 ' East 418.4 feet to
a point;
THENCE South 41° 25 ' West 33.7 feet to a
point;
THENCE South 24° 08 ' West 378. 4 feet to a
point;
THENCE North 79° 30 ' West 131. 0 feet to a
point;
THENCE South 41° 25 ' West 5.8 feet to the
point of beginning.
