RESOLUTION TO APPROVE CHANGE ORDER 1 TO CONTRACT
FOR REPAIR AND PAINTING OF 0.5 MG NINTH STREET
ELEVATED STORAGE TANK AND 0.3 MG JASPER STANDPIPE,
ACCEPT THE PROJECT AS COMPLETE, AND AUTHORIZE FINAL
PAYMENT
WHEREAS, the City of Wichita Falls has a contract with Lupton Painting
Company for the painting of the Ninth Street Elevated Water Tank and the Jasper
Plant Standpipe;
WHEREAS, the original contract cost was $89,900.00 for the painting
and repair work;
WHEREAS, the City Manager authorized one change order in the amount of
1 ,000.00, bringing the contract cost to $90,900.00;
WHEREAS, the work has been completed and the City staff has found said
work to be acceptable;
WHEREAS, after weather days are allowed, liquidated damages of $90.00
per day are to be assessed for 19 days, a total amount of $1 ,710.00; and,
WHEREAS, under the contract the City owes the contractor $9,090.00
less the liquidated damages of $1 ,710.00, an amount of $7,380.00.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
Change Order 1 to the contract is hereby approved in the amount of
1 ,000.00 bringing the total contract price to $90,900.00. The work under the
contract is hereby accepted and the City Manager is authorized to ake a final
payment of $7,380.00 to the contractor.
