RESOLUTION APPOINTING JAMES BERZINA, IN HIS
CAPACITY AS CITY MANAGER, AS TRUSTEE FOR THE
PURPOSE OF HOLDING LEGAL TITLE TO WEEKS
PARK GOLF COURSE FOR THE BENEFIT OF THE CITY
OF WICHITA FALLS, TEXAS, AND AUTHORIZING
CHARLES HARPER, MAYOR, TO TRANSFER WEEKS
PARK GOLF COURSE TO JAMES BERZINA, TRUSTEE.
WHEREAS, Mrs. Ruth Ann Allred was elected by the citizens of
District 3 to serve on the City Council of Wichita Falls, Texas;
and,
WHEREAS, it is the express desire of the City Council of
Wichita Falls, Texas, that the results of such election be given
full force and effect; and,
WHEREAS, the transfer of Weeks Park Golf Course in trust, to
James Berzina, City Manager of the City of Wichita Falls, Texas,
for the benefit of said City is desired in order to avoid
potential conflicts resulting as a consequence of the City' s
contractual relationship with Recreational Development and
Management, Inc. , and Mrs. Allred' s position of employment.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
James Berzina is hereby appointed as trustee for the purpose
of holding legal title to Weeks Park Golf Course in trust for the
benefit of the City of Wichita Falls, and Mayor Charles Harper is
hereby authorized to transfer said property to James Berzina,
trustee. The trustee shall have no authority to sell or convey
such property. Said trust shall be irrevocable, and its duration
shall extend to the time when the purpose of the trus ' no longer
exists. At that time, the trust shall expire, and - -sal and
equitable title to the conveyed ,, . -mises shall merge ' n the
beneficiary, City of Wichita Fillkil, ' exas.
