RESOLUTION DETERMINING THE NECESSITY FOR ACQUI-
SITION OF A UTILITY EASEMENT FOR THE NEW WASTE-
WATER LIFT STATION #5, APPROVING THE APPRAISAL,
SETTING JUST COMPENSATION, AND AUTHORIZING
PURCHASE OR CONDEMNATION.
WHEREAS, on May 5, 1987 , the City Council approved a contract
for the design of two wastewater lift stations; and,
WHEREAS, Biggs & Mathews, Inc. , the consulting engineers,
have determined that the City must acquire a fifteen foot wide
easement on a tract out of the John A. Scott Survey No. 18 for
installation of a sewer force main as part of lift station #5; and,
WHEREAS, this fifteen foot wide easement, totaling 0. 124
acres , has now been appraised by Henderson Appraisal and Consultants,
who were employed by the City, and such appraisal has been reviewed
by the Property Administrator and is on file in the Property
Management Office.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. It is necessary that the City of Wichita Falls
acquire the hereinafter described property located in Wichita
Falls, Wichita County, Texas, for the purpose of constructing
a new sewer force main.
SECTION 2. The legal description of the utility easement
to be acquired is as follows:
A 0. 124 acre tract out of the John A. Scott
Survey, No. 18 , as fully described by a metes
and bounds survey prepared by Biggs & Mathews,
Inc. , on May 6 , 1987 .
SECTION 3 . The amount of just compensation is set at
198. 00 , which is also the fair market value determined by
Henderson Appraisal and Consultants. The City Manager is hereby
authorized to acquire utility easement rights for a sanitary
sewer force main on the property described above, in the name
of the City of Wichita Falls.
SECTION 4. In the event that the City Manager is unable
to purchase the easement for the appraised value, he is authorized
to increase the offer when, in his judgment, it appears to be
in the best interest of the City to do so to save the cost of
condemnation. If both parties are unable to agree upon a value
for the property, the City Manager is hereby authorized and directed
to cause to be instituted condemnation proceedings to obtain
such property in the name of the City of Wichita Falls as part
of the construction of the wastewater lift station #5.
