RESOLUTION APPROVING RELEASE AND INDEMNIFICATION
OF THE UNITED STATES ARMY, AND PAYMENT OF FUEL
COSTS, FOR THE FURNISHING, TRANSPORTING AND
ERECTING OF A BAILEY BRIDGE OVER THE WICHITA
RIVER FOR FALLS FEST.
WHEREAS, the 299th Engineers of the United States Army
at Fort Sill, Oklahoma, have offered to provide, transport
and erect a Bailey Bridge for pedestrian traffic across the
Wichita River for Falls Fest, if the sponsors of the event
will pay the cost of fuel necessary to transport the bridge
and erect it, and will release the United States of liability
and indemnify it from all claims for damages arising out of
the use of the bridge.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WICHITA FALLS, TEXAS, THAT:
That certain Release and Indemnification, a copy of which
is attached hereto, is hereby approved, and the City Manager
is authorized to execute the same for the City of Wichita Falls.

RELEASE AND INDEMNIFICATION
WHEREAS, the City of Wichita Falls, Texas, the Junior
League of Wichita Falls, Inc. , and Streams and Valleys
are sponsoring a three-day celebration called "Falls Fest"
on June 5, 6 , and 7 , 1987 , in Lucy Park in the City, following
the turning on of the new waterfall by the Wichita River;
and,
WHEREAS, a large number of visitors are expected to
attend this celebration, and the City desires to provide
a pedestrian bridge across the Wichita River in the vicinity
of the Sheraton Hotel; and,
WHEREAS, the 299th Engineers of the United States
Army at Fort Sill, Oklahoma, have offered to provide, transport
and erect a Bailey Bridge at this location for this three-day
event, if the City of Wichita Falls and the other sponsors
will pay the cost of fuel necessary to transport the bridge
and erect it, and will release the United States of liability
and indemnify it from all claims for damages arising out
of the use of the bridge.
NOW, THEREFORE, the City of Wichita Falls, Texas ,
the Junior League of Wichita Falls, Inc. , and Streams and
Valleys, the sponsors of this celebration, in consideration
of the United States Army' s furnishing, transporting and
erecting such Bailey Bridge at this location for such event,
hereby agree to pay the cost of the fuel necessary to transport
and erect the bridge, to release the United States Army
of liability arising out of the use of the bridge, and
to indemnify the United States Army against all claims
for damages arising out of the use of such bridge for this
purpose.
