RESOLUTION AUTHORIZING NECESSITY TO ACQUIRE A
SEWER EASEMENT OUT OF SCOTT SURVEY 9 AS PART
OF THE HOLLIDAY CREEK PROJECT, APPROVING THE
APPRAISAL, SETTING JUST COMPENSATION, AND
AUTHORIZING PURCHASE OR CONDEMNATION.
WHEREAS, the construction of the new channel for Holliday
Creek necessitates that a sewer lift station be constructed at
30th Street and Bridwell in Wichita Falls; and,
WHEREAS, it is necessary to acquire a 0 . 36 acre strip of
land out of the John A. Scott Survey 9 , Abstract 305 , to locate
a portion of the sewer main; and,
WHEREAS, such tract has been appraised by Henderson Appraisal
and Consultants, an independent firm employed by the City of
Wichita Falls, and the appraisal has been reviewed by the Property
Administrator and is on file in the Property Management Office.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. It is necessary that the City of Wichita Falls
acquire a sewer easement on the hereinafter described property
for the purpose of installing a new pressure sewer main as part
of the Holliday Creek Project.
SECTION 2 . The legal description of the sewer easement
located in Wichita Falls, Wichita County, Texas, to be acquired
is as follows:
A 0 . 36 acre tract of land in the John A.
Scott Survey 9 , Abstract 305 , as further
described in a metes and bounds survey
prepared by Brannon Engineering, Inc. , on
April 6, 1987 .
SECTION 3 . The amount of the just compensation is to be
set at $1,255 . 00 , which is also the fair market value determined
by Henderson Appraisal and Consultants, who were employed by
the City to appraise the tract. The City Manager is hereby author-
ized to acquire a sewer easement on the 0 . 36 acre tract, described
above, in the name of the City of Wichita Falls .
SECTION 4. In the event the City Manager is unable to
purchase said tract for the appraised value, he is authorized
to increase the offer when, in his judgment, it appears to be
in the best interest of the City to do so to save the cost of
condemnation. If both parties are unable to agree upon a value
for the property, the City Manager is hereby authorized to
institute condemnation proceedings to obtain such property in
the name of the City of Wichita Falls.
