Res 070-87 5/5/1987RESOLUTION NO. 76f-0 RESOLUTION AUTHORIZING THE NECESSITY TO ACQUIRE TWO DRAINAGE EASEMENTS IN THE HILLCREST ADDITION, APPROVING APPRAISALS, SETTING JUST COMPENSATION, AND AUTHORIZING PURCHASE OR CONDEMNATION. WHEREAS, it is necessary to acquire two drainage easements in the Hillcrest Addition for installation of a storm drainage pipe; and, WHEREAS, such property has been appraised by Henderson Appraisal and Consultants, an independent appraisal firm employed by the City of Wichita Falls, and the appraisals have been reviewed by the Property Administrator and are now on file in the Property Management Office. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. It is necessary that the City of Wichita Falls acquire drainage easements on the hereinafter described property for the purpose of installing a storm drainage pipe during the reconstruction of 30th and 31st Streets. SECTION 2 . The legal descriptions of the drainage easements located in Wichita Falls , Wichita County, Texas, to be acquired are as follows: Parcel #30 BEGINNING at the northeast corner of Lot 14, Block 3 , Hillcrest Addition; THENCE West 10 feet along the north property line of Lot 14 to a point for corner; THENCE South 125 feet to the South line of Lot 14 , which said line is parallel to the East lot line; THENCE East 10 ' along the South line to the Southeast corner of Lot 14; THENCE North 125 feet along the East lot line and to the PLACE OF BEGINNING, containing 1,250 square feet, more or less. Parcel #31 BEGINNING at the Northeast corner of Lot 21, Block 3 , Hillcrest Addition; THENCE West 10 feet along the North property line of Lot 21 to a point for corner; THENCE South 125 feet to the South line of Lot 21, which said line is parallel to the East lot line; THENCE East 10 feet along the South line to the Southeast corner of Lot 21; THENCE North 125 feet along the east lot line and to the PLACE OF BEGINNING, containing 1,250 square feet, more or less. SECTION 3 . The amount of just compensation is to be set at $500 . 00 for Parcel #30 and $500 . 00 for Parcel #31, which is also the fair market value determined by Henderson Appraisal and Consultants, who were employed by the City to appraise these two tracts. The City Manager is hereby authorized to acquire drainage easements on Parcels #30 and #31, as described above, in the name of the City of Wichita Falls. SECTION 4. In the event the City Manager is unable to purchase such parcels for the appraised value, he is authorized to increase the offer when, in his judgment, it appears to be in the best interest of the City to do so to save the cost of condemnation. If both parties are unable to agree upon a value for the property, the City Manager is hereby authorized to institute condemnation proceedings to obtain such property in the name of the City of Wichita Falls .
