Res 025-87 2/17/1987RESOLUTION NO. f n RESOLUTION DETERMINING NECESSITY FOR ACQUISI- TION OF UTILITY EASEMENTS IN PORTIONS OF THE DUTTON ADDITION AND SKINNER ADDITION, APPROVING APPRAISALS OF PARCELS #627-#657 , SETTING JUST COMPENSATION, AND AUTHORIZING PURCHASE OR CONDEMNATION. WHEREAS, the City of Wichita Falls Public Utilities Depart- ment has determined that the sanitary sewer line serving the properties on Harrison and Britain Streets from Avenue C to Avenue F must be replaced; and, WHEREAS, Corlett, Probst -& Boyd, Inc. , have now completed the engineering design on the construction of a new line and identified thirty-one parcels of property which must be acquired for utility easements prior to construction; and, WHEREAS, Parcels #627-#657 have been appraised by Henderson Appraisal and Consultants, who were employed by the City, and such appraisals have been reviewed by the Property Administrator and are on file in the Property Management Office. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. It is necessary that the City of Wichita Falls acquire the hereinafter described property located in Wichita Falls, Wichita County, Texas, for the purpose of constructing a new sanitary sewer line. SECTION 2 . The legal descriptions of the utility easements to be acquired are as follows: Parcels #627 through #633 Fifteen foot wide easements off of the rear of Lots 9 through 16 , Block 1 of Dutton Addition. Parcels #634 through #637 Five foot wide easements off of the rear of Lots 1 through 4, Block 1 of Skinner Addition. Parcels #638 through #640 Ten foot wide easements off of the rear of Lots 5 through 8 , Block 1 of Skinner Addition. Parcels #641 through #645 Five foot wide easements off of the rear of Lots 1 through 4 , Block 2 of Skinner Addition. Parcels #646 through #649 Ten foot wide easements off of the rear of Lots 5 through 8 , Block 2 of Skinner Addition. Parcels #650 through #653 Five foot wide easements off of the rear of Lots 1 through 4 , Block 3 of Skinner Addition. Parcels #654 through #657 Ten foot wide easements off of the rear of Lots 5 through 8 , Block 3 of Skinner Addition. SECTION 3 . The amount of just compensation is . 5360 cents per square foot, for a total of $8 , 059 . 00 , which is also the fair market value determined by Henderson Appraisal and Consul- tants. The City Manager is hereby authorized to acquire utility easement rights on Parcels #627 - #657 , as described above, in the name of the City of Wichita Falls . SECTION 4 . In the event that the City Manager is unable to purchase such parcels for the appraised value, he is authorized to increase the offer when, in his judgment, it appears in the best interest of the City to do so to save the cost of condemnation. If both parties are unable to agree upon a value for the property, the City Manager is hereby authorized and directed to cause to be instituted condemnation proceedings 2- to obtain such property in the name of the City of Wichita Falls for the Harrison-Britain sanitary sewer line.
