Res 017-87 2/3/1987r RESOLUTION NO. 17-87 RESOLUTION DECLARING LEASE ON LOT 16 , BLOCK J, EAST SIDE OF LAKE ARROWHEAD TERMINATED, ALLOW- ING PARTIES TO RESIDE THEREON FOR SIX (6) MONTHS, AND AUTHORIZING TRANSFER TO PURCHASER. WHEREAS, Corene Hammers was lessee of Lot 16 , Block J, East Side of Lake Arrowhead by virtue of a lease dated June 29 , 1982 , which lease has been declared terminated by the City for breach of covenants; and, WHEREAS, Ms. Hammers ' daughter and son-in-law, Joeie and D. E. Hill have requested that they be allowed to maintain their residence on the lot pending the sale of the house they have built thereon. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Such lease is terminated, but Joeie and D. E. Hill are hereby authorized to maintain their residence in the house on such lot for a period of six (6) months from this date, pending the sale of such house. If the Hills sell such house within this period to a purchaser acceptable to the City as a lessee, and the premises meet the requirements of the City for a transfer of a lot at Lake Arrowhead, the City will approve the sale and issue a new lease to the purchaser for a term equal to the unexpired term remaining on the 1982 lease. If, during such temporary residence on the lot, the Hills commit or allow any health or safety hazard, they will be required to move from the lot immediately. If the Hills fail to sell such improvements within such six (6) month period, they will be required to move from the lot and remove their improvements; if they fail to remove the improvements, the City shall have the right to enter upon the premises and sell the improvements to the highest bidder at either a public or private sale, as provided in paragraph 10 of the lease.
