RESOLUTION DETERMINING NECESSITY FOR
ACQUISITION OF PROPERTY FOR THE EXTENSION OF
THE RIVER TRAIL SYSTEM, APPROVING THE
APPRAISALS, SETTING JUST COMPENSATION, AND
AUTHORIZING PURCHASE OR CONDEMNATION.
WHEREAS, in May 1988, Phase II of the river trail system was
completed which extended approximately 2,300 linear feet of trail
from Lucy Park to The Falls; and,
WHEREAS, the Public Works Department has completed the
design for the Phase III river trail extension from The Falls to
O'Reilly Park; and,
WHEREAS, it has been determined that eleven parcels of
property must be acquired for this phase and such parcels have
now been appraised, and the appraisals have been reviewed by the
Property Administrator and are now on file in the Property
Management Office.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. It is necessary that the City of Wichita Falls
acquire the hereinafter described property located in Wichita
Falls, Wichita County, Texas, for the purpose of constructing
Phase III of the Wichita River Trail System.
SECTION 2. The legal descriptions of the parcels to be
acquired in fee simple title are as follows:
Parcel #RT -1
A 0.44 acre tract out of Block N, Original
Townsite, as fully described by metes and
bounds in a field survey prepared by Biggs &
Mathews, Inc., on November 9, 1988.
Parcel #RT -2
All of Block 97, Original Townsite of Wichita
Falls, a /k /a 100 No. Burnett Street.
Parcel #RT -3
All of Block 96, Original Townsite of Wichita
Falls, a /k /a 101 No. Burnett Street.
Parcel #RT -4
All of Block 95, Original Townsite of Wichita
Falls, a /k /a 1000 Second Street.
Parcel #RT -5
All of Block 94, Original Townsite of Wichita
Falls, a /k /a 112 No. Lamar and 908 Second
Street.
Parcel #RT -6
A 0.42 acre tract out of Lot 8, Lots 22 -25,
and a portion of two closed alleys in Block
93, Original Townsite, as fully described by
metes and bounds in a field survey prepared

SECTION 3. The amount of just compensation for the eleven
parcels described above is to be set as follows:

These amounts are also the fair market value determined by
Henderson Appraisal and Consultants, who were employed by the
City to appraise these tracts. The City Manager is hereby
authorized to acquire fee simple title to these eleven parcels
described above in the name of the City of Wichita Falls.
SECTION 4. In the event the City Manager is unable to
purchase such parcels for the appraised value, he is authorized
to increase the offer when, in his judgment, it appears to be in
the best interest of the City to do so to save the cost of
condemnation. If both parties are unable to agree upon a value
for the property, the City Manager is hereby authorized to
institute condemnation proceedings to obtain such property in the
name of the City of Wichita Falls for the Wichita River Trail
System.
