RESOLUTION TO AUTHORIZE THE MAYOR OF WICHITA FALLS TO SIGN A DEED
RETURNING LAND PURCHASED AT A TAX SALE TO PROPERTY OWNER.
WHEREAS, on the 12th day of January, 1988, the City View
Independent School District along with the City of Wichita Falls and
Wichita County recovered a ,judgment in the 30th District Court of
Wichita County, Texas, against John M. Kirksey in Cause No. 37, 128 -A,
styled The City of Wichita Falls, et al vs. John M. Kirksey, for
delinquent taxes, penalties and interest on the following described
property:
THE SOUTH ONE -HALF (112) OF LOT 11, BLOCK D, CITY VIEW ADDITION
TO THE CITY OF WICHITA FALLS, TEXAS, AS MORE PARTICULARLY
DESCRIBED IN A DEED RECORDED IN VOLUME 1279 AT PAGE 686 OF THE
DEED RECORDS OF WICHITA COUNTY, TEXAS, LOCATED AT LONGVIEW AND
CITY VIEW DRIVE, WICHITA FALLS, WICHITA COUNTY, TEXAS.
AND WHEREAS, the District Clerk of the 30th District Court of
Wichita County, Texas, issued an order of sale pursuant to the
judgment commanding the Sheriff of Wichita County, Texas, to seize,
levy upon, advertise for sale and sell the property;
AND WHEREAS, on April 28, 1988, the Sheriff of Wichita County,
Texas, did levy on the property and thereafter advertised the property
for sale once a week for three consecutive weeks with the first such
advertisement appearing the 15th day of May, 1988;
AND WHEREAS, on the 7th day of June, 1988, being the first
Tuesday of such month, the Sheriff of Wichita County, Texas, bid the
property off to the City View Independent School District;
AND WHEREAS, the City View Independent School District is
currently holding title to the property for itself and for the benefit
of the City of Wichita Falls and Wichita County, Texas;
AND WHEREAS, John M. Kirksey has paid the taxes, penalties,
interest, costs of suit, costs of advertising, Sheriff's fees and
redemption fees to the respective taxing units interested in the tax
foreclosure judgment against the above described property;
NOW, THEREFORE, BE IT RESOLVED that the City of Wichita Falls
hereby acknowledges such redemption by John M. Kirksey of the property
described above and authorizes the May of the City of Wichita Falls to
execute, on behalf of the City of Wichita Falls, a Cancellation of Tax
Deed and Quitclaim Deed of the above described property to John M.
Kirksey.
