RESOLUTION AUTHORIZING THE NECESSITY
TO ACQUIRE TWO EASEMENTS ON PAWHUSKA
STREET, APPROVING APPRAISALS, SETTING
JUST COMPENSATION, AND AUTHORIZING
PURCHASE OR CONDEMNATION
WHEREAS, it is necessary to acquire a permanent drainage
easement and a temporary construction easement on Pawhuska Street
in conjunction with the planned street reconstruction project;
and
WHEREAS, such property has been appraised, and the
appraisals have been reviewed by the Property Administrator and
are now on file in the Property Management Office.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
Section 1. It is necessary that the City of Wichita Falls
acquire a drainage easement and a temporary construction easement
on the hereinafter described property for the purpose of making
drainage improvements on Pawhuska Street.
Section 2. The legal description of the drainage easement
located in Wichita Falls, Wichita County, Texas, to be acquired
in as follows:
Parcel #P -1
A 10' x 30' strip off of the east side of a four acre
tract in the Robert Evans Survey, Abstract 74 and being
out of a tract described in Volume 517 Page 143 of the
Wichita County deed records. Said 10' x 30' tract
being further described on the Pawhuska Street
Reconstruction Plans prepared by the City of
Wichita Falls Public Works Department.
The legal description of the temporary construction easement
to be acquired is as follows:
Parcel #P -2 (TCE)
All of Lot 6, Block B, West Indian Heights Addition,
also known as 2110 Pawhuska Street.
Section 3. The amount of just compensation is to be set at
$60.00 for Parcel #P -1 and $490.00 for Parcel #P -2 (TCE), which
is also the fair market value determined by Henderson Appraisal
and Consultants, who were employed by the City to appraise these
two tracts. The City Manager is authorized to acquire a drainage
easement on Parcel #P -1 and a temporary construction easement for
a period of one year on Parcel #P -2 (TCE), as described above, in
the name of the City of Wichita Falls.
Section 4. In the event the City Manager is unable to
purchase such parcels for the appraised value, he is authorized
to increase the offer when, in his judgement, it appears to be in
the best interest of the City to do so to save the cost of
condemnation. If both parties are unable to agree upon a value
for the property, the City Manager is hereby authorized to
institute condemnation proceedings to obtain such property in the
name of the City of Wichita Falls.
