Res 141-88 7/5/1988RESOLUTION NO. 611—& RESOLUTION TO ACCEPT JASPER STREET WATER TREATMENT PLANT RENOVATION PROJECT AS COMPLETE AND AUTHORIZE THE CITY MANAGER TO MAKE FINAL PAYMENT WHEREAS, the City of Wichita Falls has a contract with Decker Construction Company, Incorporated of Abilene, Texas for renovations at the Jasper Street Water Treatment Plant; WHEREAS, the original contract in the amount of $403,900.00 was increased by two change orders to $433,000.00; WHEREAS, previous payments of $404,780.00 have been made, leaving an amount due of $21,650.00; WHEREAS, the contract provided for liquidated damages of $150.00 per calendar day for each additional day beyond 75 days the upflow clarifier was out of service; WHEREAS, 30 days of liquidated damages are to be assessed on this contract, an amount of $4,500.00, leaving a total amount due to the contractor of $17,150.00; and, WHEREAS, the City staff has inspected the work and found it acceptable, and has recommended Council accept this project as complete. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The project to renovate the Jasper Street Water Treatment Plant is accepted and the City Manager is authorized to make a final payment to Decker Construction Company, Incorporated, in the amount of $17,150.00. PASSED AND APPROVED THIS THE 5TH DAY OF JULY, 1988. ATTEST: CITY CLERK
