RESOLUTION DETERMINING THE NECESSITY FOR ACQUISITION
OF PARCEL #14-D FOR THE HOLLIDAY CREEK PROJECT,
APPROVING THE APPRAISAL, SETTING JUST COMPENSATION,
AND AUTHORIZING CONDEMNATION.
WHEREAS, certain parcels have been designated for
acquisition in order to provide drainage and utility right-of-way
for the realignment of Holliday Creek; and,
WHEREAS, the Property Management Office has been unable to
locate the owner or heirs to Parcel #14-D, and fee simple title
to said property will therefore be acquired through condemnation
proceedings; and,
WHEREAS, the appraisal has been completed on said Parcel
#14-D, and the appraisal has been reviewed by the Property
Administrator and is now on file in the Property Management
Office.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. It is necessary that the City of Wichita Falls
acquire the hereinafter described property located in Wichita
Falls, Wichita County, Texas, for the purpose of providing
adequate right-of-way for drainage and utilities in Phase II of
the Holliday Creek Project.
SECTION 2. The legal description of the property to be
acquired in fee title is as follows:
Parcel #14-D
A 0.1837 acre tract (8,000 square feet),
being all of the remainder of Block 30,
Barwise and Jalonick Addition, also known as
411 Denison Street.
SECTION 3. The amount of just compensation for the fee
simple title to Parcel #14-D is to be set at $960.00.
This amount is also the fair market value determined by
Henderson Appraisal and Consultants, who were employed by the
City to appraise the tract. The City Manager is hereby
authorized to acquire fee simple title to Parcel #14-D as
described above in the name of the City of Wichita Falls.
SECTION 4. The City Manager is hereby authorized to
institute condemnation proceedings to obtain said property in the
name of the City of Wichita Falls for the Holliday Creek Channel
Improvement Project.
