RESOLUTION TO ACCEPT U.S. 287 PUMP STATION
PROJECT AS COMPLETE AND AUTHORIZE CITY MANAGER TO
MAKE FINAL PAYMENT TO CONTRACTOR
WHEREAS, the City of Wichita Falls has a contract with
Brown -McKee for the construction of a water pump station on U.S.
Highway 287 West and certain other work in the water distribution
system;
WHEREAS, the original contract price of $407,727.00 has been
increased by the amount of 3 separate change orders to a total of
$412,911.45;
WHEREAS, the contractor has previously been paid an amount
of $392,265.88, leaving an amount due of $20,645.57;
WHEREAS, the contractor exceeded the allowable contract time
by 5 calendar days, at a cost of $300.00 per day for liquidated
damages, a total deduction from the amount owed of $1,500.00,
leaving a final payment to the contractor of $19,145.57; and,
WHEREAS, the staff has inspected the work, found it complete
and recommended acceptance.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The U.S. 287 West Pump Station Project is hereby accepted as
complete and the City Manager is authorized to make a final
payment of $19,145.57 to the contractor.
PASSED AND APPROVED THIS THE 17TH DAY OF MAY, 1988.
