RESOLUTION APPROVING CHANGE ORDER NO. 3, ACCEPTING
CONSTRUCTION AND AUTHORIZING FINAL PAYMENT TO THE
CONTRACTOR FOR COMPLETION OF THE RIVER TRAIL CDBG
PROJECT
WHEREAS, the City of Wichita Falls entered into a contract
with Taylor and Company Inc. for the construction of the Lucy
Park River Trail CDBG Project; and,
WHEREAS, said project has been completed in accordance with
the plans and specifications, excepting only conditions described
in Change Order No. 3 for which the contractor requests an
additional $1,255.00; and,
WHEREAS, said contract was a unit price contract and the
estimated cost based on actual quantities with Change Order No. 3
is $84,583.23; however, $78,807.09 has been paid to the
contractor, and $700.00 has been assessed as liquidated damages
to the contractor, leaving a balance due of $5,076.14; and,
WHEREAS, this project was inspected and complete on April 8,
1988.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The construction of said project is accepted by the City of
Wichita Falls, Change Order No. 3 is approved, and the City
Manager is authorized to pay the contractor the amount as bet out
above.
