RESOLUTION TO ACCEPT CONSTRUCTION OF 1.0 MG
ELEVATED STORAGE TANK AND AUTHORIZE CITY
MANAGER TO MAKE FINAL PAYMENT
WHEREAS, the City of Wichita Falls has a contract with
Hydrostorage, Inc. for the construction of a 1.0 MG elevated
water storage tank, said contract being let in the original
amount of $666,800.00;
WHEREAS, three change orders have been previously approved
in the total amount of $17,625.00, bringing the current contract
total cost to $684,425.00;
WHEREAS, the City has previously paid the contractor
$637,098.50 leaving an amount due of $47,326.50;
WHEREAS, the contractor exceeded the agreed completion date
by 60 days, 38 of which were due to abnormal and unforeseeable
weather conditions, leaving a total of 22 days for which the
contractor is to be charged liquidated damages in accordance with
the contract at the rate of $250.00 per calendar day;
WHEREAS, the total liquidated damages of $5,500.00 leaves an
amount due to the contractor of $41,826.50; and,
WHEREAS, the staff has inspected the project and found it to
be acceptable.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The contract with Hydrostorage, Inc. to construct a 1.0 MG
elevated water storage tank is hereby accepted and the City
Manager is authorized to make a final payment of $41,826.50 to
the contractor.
