RESOLUTION ACCEPTING CONSTRUCTION AND
AUTHORIZING FINAL PAYMENT TO THE CONTRACTOR
FOR THE HOLLIDAY CREEK EROSION CONTROL
PROJECT
WHEREAS, the City of Wichita Falls, Texas entered into an
contract with the firm of M&E Soils Service for the construction
of the Holliday Creek Erosion Control Project for the estimated
sum of $115,212.50, which project has been successfully
completed, and;
WHEREAS, the contract was a unit price contract and the
amount due when computed from the bid amount is $56,286.83,
however, $50,562.64 has already been paid to the contractor
leaving an amount due of $5,724.19, and;
WHEREAS, delays in the completion of the work were in no way
the fault of the contractor.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT;
The Holliday Creek Erosion Control Project is accepted,
liquidated damages as outlined in the contract are waived and the
City Manager is authorized to complete payment to the contractor
in the amounts outline above. A /
