RESOLUTION NO. ( A- d D
RESOLUTION APPROVING THE APPRAISAL OF PARCELS
#28 -A, #29, #29 -S, #55, #56 -B, #56 -C, #56 -D,
AND #58 -D FOR THE HOLLIDAY CREEK CHANNEL
IMPROVEMENT PROJECT, SETTING JUST COMPENSATION,
AND AUTHORIZING PURCHASE OR CONDEMNATION.
WHEREAS, in accordance with the plans for Phase II of the
Holliday Creek Channel Improvement Project, the appraisals have
been completed on eight additional parcels of property, and such
appraisals have been reviewed by the Property Administrator and
are now on file in the Property Management Office.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. It is necessary that the City of Wichita Falls
acquire fee simple title to Parcels #28 -A and #56 -B and drainage
and utility easements to Parcels #29, #29 -S, #55, #56 -C, #56 -D,
and #58 -D on the hereinafter described property for the purpose
of constructing the Holliday Creek Channel Improvement Project.
SECTION 2. The legal descriptions of the property to be
acquired in fee simple title located in Wichita Falls, Wichita
County, Texas, to be acquired are as follows:
Parcel #28 -A
A 1.045 acre tract out of Block 19 of the
Kemp and Newby Subdivision of the Southeast
quarter of J. A. Scott Survey 11, as fully
described by metes and bounds in a field
survey prepared by Corlett, Probst & Boyd,
Inc., in February, 1988.
Parcel #56 -B
A 0.4151 acre tract, more or less, out of
Block 8 of Sayles Irrigation Subdivision of
the J. A. Scott Survey No. 10 and being the
same tract as fully described in Volume 1153,
Page 836 of the Wichita County deed records.
The legal descriptions of the drainage and utility easements
located in Wichita Falls, Wichita County, Texas, to be acquired
are as follows:

quarter of J. A. Scott Survey No. 11 as fully
described by metes and bounds in a field
survey prepared by Corlett, Probst & Boyd,

Parcel #29 -S
A 0.069 acre tract out of Block 19 of Kemp
and Newby Subdivision of the Southeast
quarter of J. A. Scott Survey No. 11, as
further described by metes and bounds in a
field survey prepared by Corlett, Probst &
Boyd, Inc., on March 11, 1988.
Parcel #55
A 0.229 acre tract out of Block 8 of Sayles
Irrigation Subdivision of J. A. Scott Survey
No. 10, as further described by metes and
bounds in a field survey prepared by Corlett,
Probst & Boyd, Inc., in February, 1988.
Parcel #56 -C
A 0.097 acre tract out of Block 8 of Sayles
Irrigation Subdivision of the J. A. Scott
Survey No. 10, as further described by metes
and bounds in a field survey prepared by
Corlett, Probst & Boyd, Inc., in February,
1988.

A 0.026 acre tract out of Block 8 of the
Sayles Irrigation Subdivision of J. A. Scott
Survey No. 10, as further described by metes
and bounds in a field survey prepared by

A 0.720 acre tract out of Block 8 of the
Sayles Irrigation Subdivision of J. A. Scott
Survey No. 10, as further described by metes
and bounds in a field survey prepared by
Corlett, Probst & Boyd, Inc., in February,
1988.

These amounts are also the fair market value determined by
Henderson Appraisal and Consultants, who were employed by the
City to appraise these tracts. The City Manager is hereby
authorized to acquire fee simple title to Parcels #28 -A and #56-
B, and drainage and utility easements on Parcels #29, #29 -5, #55,
#56 -C, #56 -D, and #58 -A as described above, in the name of the
City of Wichita Falls.
Section 4. In the event the City Manager is unable to
purchase such parcels for the appraised value, he is authorized
to increase the offer when, in his judgment, it appears to be in
the best interest of the City to do so to save the cost of
condemnation. If both parties are unable to agree upon a value
for the property, the City Manager is hereby authorized to
institute condemnation proceedings to obtain such property in the
name of the City of Wichita Falls for the Holliday Creek Channel
Improvement Project.
