Res 061-88 4/5/1988RESOLUTION NO. �/—// RESOLUTION APPROVING THE APPRAISAL OF PARCELS #14, #15, #16, #17, #18, #19, #20 -A, #21, AND #56 -E FOR THE HOLLIDAY CREEK CHANNEL IMPROVEMENT PROJECT, SETTING JUST COMPENSATION, AND AUTHORIZING PURCHASE OR CONDEMNATION. WHEREAS, in accordance with the plans for Phase II of the H011iday Creek Channel Improvement Project, the appraisals have been completed on nine additional parcels, and such appraisals have been reviewed by the Property Administrator and are now on file in the Property Management office. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. It is necessary that the City of Wichita Falls acquire drainage and utility easements on Parcels #14, #15, #16, #17, #18, #19, #20 -A, #21, and #56 -E on the hereinafter described property for the purpose of constructing the Holliday Creek Channel Improvement Project. SECTION 2. The legal descriptions of the property to be acquired by drainage and utility easements located in Wichita Falls, Wichita County, Texas, are as follows: Parcel #14 A 2.970 acre tract out of the Northwest quarter of the J. A. Scott Survey No. 11, as described by metes and bounds in a field survey prepared by Biggs & Mathews, Inc., on February 19, 1988. Parcel #15 Tract 1 A 1.866 acre tract out of the Northwest quarter of J. A. Scott Survey No. 11, as described by metes and bounds in a field survey prepared by Biggs & Mathews, Inc., on February 22, 1988. Parcel #15 Tract 2 A 0.4396 acre tract out of the Northwest quarter of J. A. Scott Survey No. 11, as described by metes and bounds in a field survey prepared by Biggs & Mathews, Inc., in March, 1988. Parcel #16 Tract 1 A 2.425 acre tract out of the Northeast quarter of the J. A. Scott Survey No. 11, as described by metes and bounds in a field survey prepared by Biggs & Mathews, Inc., on February 19, 1988. Parcel #16 Tract 2 A 0.0907 acre tract out of the Northeast quarter of the J. A. Scott Survey No. 11, as described by metes and bounds in a field survey prepared by Biggs & Mathews, Inc., in March, 1988. Parcel #17 A 1.040 acre tract out of the Northwest quarter of the J. A. Scott Survey No. 11, as described by metes and bounds in a field survey prepared by Biggs & Mathews, Inc., on February 22, 1988. Parcel #18 A 0.175 acre tract out of the Northwest quarter of the J. A. Scott Survey No. 11, as described by metes and bounds in a field survey prepared by Biggs & Mathews, Inc., on February 19, 1988. Parcel #19 A 2.765 acre tract out of Block 1 of the Kemp and Newby Subdivision of the Southeast quarter of the J. A. Scott Survey No. 11, as described by metes and bounds in a field survey prepared by Biggs & Mathews, Inc., on February 19, 1988. Parcel #20 -A A 1.705 acre tract out of Block 9 of the Kemp and Newby Subdivision of the Southeast quarter of the J. A. Scott Survey No. 11, as described by metes and bounds in a field survey prepared by Biggs & Mathews, Inc., on February 18, 1988. Parcel #21 A 0.794 acre tract out of Block 9 of the Kemp and Newby Subdivision of the Southeast quarter of the J. A. Scott Survey No. 11, as described by metes and bounds in a field survey prepared by Biggs & Mathews, Inc., on February 18, 1988. Parcel #56 -E A 0.187 acre tract out of Block 8 of the Sayles Irrigation Subdivision of the J. A. Scott Survey No. 10, as described by metes and bounds in a field survey prepared by Corlett, Probst & Boyd, Inc., in February, 1988. SECTION 3. The amount of just compensation to be set for the drainage and utility easements is as follows: #14 $ 7,762.00 #19 $9,635.00 #15 6,026.00 #20 -A 8,912.00 #16 6,575.00 #21 2,767.00 #17 3,624.00 #56 -E 652.00 #18 762.00 These amounts are also the fair market value determined by Henderson Appraisal and Consultants, who were employed by the City to appraise these tracts. The City Manager is hereby authorized to acquire drainage and utility easements on Parcels #14, #15, #16, #17, #18, #19, #20 -A, #21, and #56 -E as described above, in the name of the City of Wichita Falls. SECTION 4. In the event the City Manager is unable to purchase such parcels for the appraised value, he is authorized to increase the offer when, in his judgment, it appears to be in the best interest of the City to do so to save the cost of condemnation. If both parties are unable to agree upon a value for the property, the City Manager is hereby authorized to institute condemnation proceedings to obtain such property in the name of the City of Wichita Falls for the Holliday Creek Channel Improvement Project.
