Res 051-88 3/15/1988RESOLUTION NO. RESOLUTION ACCEPTING THE CONSTRUCTION OF HOLLIDAY CREEK EXCAVATION PROJECT - PHASE I AND AUTHORIZING FINAL PAYMENT TO THE CONTRACTOR WHEREAS, the City of Wichita Falls entered into a unit price contract with Zack Burkett Company dated November 19, 1985, for the Holliday Creek Excavation Project - Phase I; and, WHEREAS, the actual cost of said contract with change orders was $1,439,678.02, however, being that $1,336,846.04 has previously been paid to the contractor and that, further, $35,200.00 is rightfully due to the City as payment for liquidated damages after an extension to the contract time to compensate the contractor for weather conditions, and further that the Zack Burkett Company is duly owed $4,124.70 in payment for the City's portion of the street reconstruction as required by the contract leaving an amount due of $71,756.67. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The referenced contract is amended to extend the contract completion date by seven days, and, the project is accepted, and the City Manager is authorized to make final payment to the contractor in the amount of $71,756.67. /,' 1 / I M A Y CQ R ATTEST: CIT7 CLERK
