RESOLUTION APPROVING FIRST AMENDMENT
TO CONTRACT FOR CATERING SERVICES AT
THE WICHITA FALLS ACTIVITIES CENTER
WHEREAS, the City of Wichita Falls and Cantu Services, Inc.
entered into a contract dated February 17, 1987, providing for
catering services at the Activities Center for the period beginning
February 28, 1987, and ending February 29, 1988; and,
WHEREAS, the parties desire to amend such contract to extend the
contract for an additional one -year period.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
That certain First Amendment to Contract for Catering Services at
the Wichita Falls Activities Center, a copy of which is attached
hereto, is hereby approved, and the City Manager is authorized to
execute the same for the City of Wichita Falls.

FIRST AMENDMENT TO CONTRACT FOR
CATERING SERVICES AT THE
WICHITA FALLS ACTIVITIES CENTER
This First Amendment made and entered into this the day
of March, 1988, by and between the City of Wichita Falls Activities
Center, hereinafter referred to as "Center," and Cantu Services,
Inc., hereinafter referred to as "Caterer,"
WITNESSETH:
WHEREAS, the parties entered into a contract dated February 17,
1987, providing for catering services within the Activities Center
building for the period beginning February 28, 1987, and ending
February 29, 1988; and
WHEREAS, the contract provided that it may be extended by
mutual agreement of the parties for an additional one -year period.
NOW, THEREFORE, the parties hereto do hereby agree that the
following sections are hereby amended to read as follows:
I. Contract Term
A. The term of this contract shall be for a one -year period
beginning March 1, 1988, and ending February 28, 1989.
II. Exclusive Concession Rights
A. The Caterer shall have the exclusive right to the use of
the Center's kitchen and all kitchen equipment. No
caterer, group or individual shall be permitted to utilize
the kitchen or kitchen equipment.
IV. Operating Conditions
A. The Center shall furnish without charge to the Caterer
existing equipment and storage and commissary space for
stock and equipment as per Attachment A. The storage
space utilized by the Caterer shall include the long
closet in the hallway leading to the freight dock. Should
additional space be required, the Caterer may request such
from the Manager. Any additional space granted by Manager
may be used by Caterer, but such use may be revoked by
Manager within twenty -four (24) hours notice.
VII. Price and Ouality of Merchandise
D. The Caterer shall assess a twenty dollar ($20) labor
charge for any event held on a weekday after 4 p.m.,
Saturday, Sunday, or any other time the Caterer is
required to.bring in additional personnel to cater that
event.
E. The Caterer shall assess a surcharge of twenty -five
percent (25 %) to any non - regular event catered for less
than thirty (30) people booked after the date of this
amendment.
X. Bonds and Insurance

C. The Caterer shall execute an irrevocable letter of credit
in the amount of Six Thousand Dollars ($6,000.00),
guaranteeing the faithful performance of all conditions
contained in this contract and for the prompt payment of
contractual indebtedness within five (5) days of execution
of the contract.
