RESOLUTION TO AWARD BID FOR INSTALLATION
OF CARPET AT THE KEMP PUBLIC LIBRARY OF
WICHITA FALLS
WHEREAS, the City of Wichita Falls has advertised for bids
for installation of carpet at the Kemp Public Library of Wichita
Falls; and
WHEREAS, Simpson Carpet Company has been determined to be
the lowest and best qualified responsible bidder.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The bid of $10, 348 is hereby accepted and the City Manager
is authorized to execute a contract with Simpson Carpet Company,
a copy of which is hereto attached, for installation of carpet at
the Kemp Public Library of Wichita Falls.

CONTRACT
STATE OF TEXAS
COUNTY OF WICHITA
THIS AGREEMENT, made and entered into this the 16th day of
May, 1989, by and between the City of Wichita Falls, County of
Wichita, State of Texas, acting by and through its City Manager,
who is duly authorized so to act hereinafter referred to as the
OWNER, and Simpson Carpet Company, of the City of Wichita Falls,
County of Wichita, and State of Texas, hereinafter referred to as
the CONTRACTOR.
WITNESSETH:
That for and in consideration of the payment of Ten Thousand
Three Hundred and Forty Eight and No/100 ( $10,348. 00) Dollars by
the OWNER, the CONTRACTOR hereby agrees with OWNER to commence
and complete the construction of certain improvements described
as follows: installation of carpet and underlayment at the Kemp
Public Library in accordance with the specifications and
conditions contained in Exhibit A attached hereto and
incorporated herein for all purposes. Contractor agrees to
furnish all materials, supplies, machinery, equipment, tools,
labor and other accessories required to fully complete the work
under this agreement.

The CONTRACTOR hereby agrees to complete the work within
five ( 5) days from CONTRACTOR' S receipt of carpet from the
manufacturer. CONTRACTOR shall furnish OWNER with a signed copy
of the Bill of Lading or other instrument as may be required by
OWNER to document his receipt of carpet from the manufacturer.
The CONTRACTOR shall be charged as liquidated damages the sum of
50. 00 per day for each calendar day that the work remains
incomplete beyond the time fixed for the completion.
IN WITNESS WHEREOF, the parties to these presents have
executed this agreement in Wichita Falls, Texas, in the year and
day first above written.

SPECIFICATIONS AND INSTRUCTIONS TO BIDDERS
FOR KEMP PUBLIC LIBRARY CARPET INSTALLATION
1.00 INSTRUCTIONS TO BIDDERS
Sealed bids should be delivered to the office of the
Purchasing Agent, City of Wichita Falls, Memorial Auditorium,
Room 111, 1300 Seventh Street, Wichita Falls, Texas, 76307 , by

Bids shall be submitted on the attached bid form.
Any questions concerning the library or the proposed work
should be directed to Library Administrator Tiana Williams during

1.01 SCOPE OF WORK
Work to be included under this Contract consists of
furnishing all materials, supplies, equipment, tools,
transportation, and facilities; and performance of all labor and
services necessary or required in connection with or incidental
to the installation of underlayment and carpet in accordance with
drawings and specifications.
1.02 INSURANCE
Obtain, pay for, and maintain, at all times during the
execution of the work under this Contract, public liability and
property damage insurance (through companies and agencies
approved by the City and containing provisions satisfactory to
the City) for a minimum of $100,000.00 for one person and
300,000. 00 for one accident. Property damage insurance shall be
in the sum of $100,000.00. Such policy shall include the City of
Wichita Falls as an additional insured. The contractor shall
procure and shall maintain during the life of this contract,
Statutory Workmen' s Compensation Insurance for all his employees
to be engaged in work for the project under this contract.
Contractor shall furnish proof of such insurance before beginning
work.

1.03 STATE SALES TAX
The contractor shall claim an exemption from payment of
taxes under Chapter 20, Title 122A, Article 20.04(f) ( 4) , Revised
Civil Statutes of Texas, for the purchase of tangible personal
property.
1.04 GUARANTEE
Each subcontractor shall, at his own expense, amend and make
good any defects, settlements, or other faults in the work
arising from defective or improper materials or workmanship,
which may appear within twelve ( 12) months after the acceptance
of work.
1.05 RESPONSIBILITY
The contractor will be held responsible for the satisfactory
and complete execution of all work included in the Contract and
shall provide all incidental items required as part of the work,
whether each such item is particularly specified, indicated or
not. If the contractor has a reasonable objection to the use of
any material or method of work shown or specified, he shall
report such objections to the City for adjustment and, unless his
objection is sustained, shall proceed with the work as called for
herein, with the understanding that a satisfactory job will be
required.
1.06 MEASUREMENTS
Before ordering any material or doing any work, contractor
shall verify all measurements and conditions at the site and be
responsible for the correctness of the same. Extra charges, or
compensation, will not be allowed on account of differences
between actual measurements and the dimensions shown on the
drawings. Contractor shall submit any such differences which may
be found to City' s attention and have adjustments made before
proceeding with the work.
1.07 UTILITIES FOR CONSTRUCTION PURPOSES - By City.
1.08 SPECIAL NOTES
Prior to submittal of a bid, each bidder shall make, and
will be deemed to have made, a careful examination of the
premises and all conditions existing thereon and of the drawings
and specifications.
The right is reserved, as the interests of the City may
require, to accept or reject all bids, or part thereof, or to
waive any irregularities or informalities in any bid received.

1.09 COMPLIANCE WITH LOCAL LAWS.
The contractor shall comply with applicable laws,
ordinances, and codes of the State and local governments and the
contractor shall save and hold harmless the City with respect to
damages arising from any tort committed in performing any of the
work embraced by this Contract.
1.10 COMPLETION TIME.
The anticipated award of bid for this work is May 16, 1989.
Because the ability of the Library to operate is severely
hampered by the requirements of this contract, time is of the
essence in completing the work to be performed hereunder.
Therefore, you must include the number of calendar days needed to
complete the specified work, which may be considered by the City
in the award of this Contract. Additional time to complete the
work may be permitted for unavoidable accidents caused by
unforeseen matters only if the contractor has no control over
such matter and has not contributed to such delay.
1.11 LIQUIDATED DAMAGES.
The contractor shall be charged as liquidated and
ascertained damages the sum of $50. 00 per day for each calendar
day that the work remains incomplete beyond the time fixed for
the completion.
1.12 DISCRIMINATION.
The contractor agrees not to engage in employment practices
which have the effect of discriminating against any employee or
applicant for employment; and, will take affirmative steps to
ensure that applicants are employed and employees are treated
during employment without regard to their race, color, religion,
national origin, sex, age, handicap, or political belief or
affiliation.
2.00 SPECIFICATIONS
A. Particle Board Underlayment.
B. Carpeting.
2.01 SCOPE
A. Remove existing carpet and padding in the areas noted
on Plan Sheet. Disposal of carpet shall be the
responsibility of the contractor and should be removed
to an approved location.

B. Furnish and install 1/2" particle board underlayment
throughout area to receive carpet. Type of materials,
means of attachment and placement shall comply with
City of Wichita Falls Building Code.
C. Furnish and install by "direct glue" method carpeting
as shown on drawing and specified herein. All work
shall be in accordance with manufacturer' s
recommendation for installation utilizing compatible
materials.
2.02 INSPECTION
Examine all subsurfaces to receive work and report to owner
any conditions detrimental to work. Failure to observe this
requirement constitutes a waiver to any subsequent claims to the
contrary and holds carpet contractor responsible for any
corrections owner may require. Commencement of work will be
construed as acceptance of all subsurfaces.
2.03 QUALIFICATION
On owner' s request, provide evidence of at least five years
of experience at this type of installation.
2.04 GENERAL REQUIREMENTS
A. Install 1/2" particle board underlayment in a
workmanlike manner utilizing #6 spiral thread or
annular nails placed 6" O.C. at edges and at 10" O.C.
intermediately. Insure that placement of underlayment
follows building lines and is placed perpendicular to
floor joist. No underlayment joint shall align in the
short dimension. At columns and existing floor
penetrations underlayment shall provide a tight fit.
Provide access for electrical, mechanical, plumbing,
telephone or other penetrations of the floor allowing
devices to pass without binding and insure
serviceability. Upon completion of placing
underlayment remove all overage from building, sweep
clean and insure readiness to receive carpet.
B. Perform complete carpeting operation, including floor
preparation, laying, trimming, seaming, stretching,
tucking, etc.
C. Furnish owner complete carpet care and maintenance
instructions bound in a looseleaf binder.

2.05 INSTALLATION OF CARPET
A. Cutting and fitting: Neatly cut and fit carpet all
penetrations through floors. Insure that carpet fits
tight against walls, columns, pilasters and other
building structural elements.
B. Seaming: Lay carpet with a minimum of seams. Seam,
where required, with tape and cement or other approved
means as recommended by the carpet manufacturer.
C. Installation shall be with adhesives which meet or
exceed carpet manufacturer' s recommendations for
application utilizing "direct glue" application over
particle board underlayment.
2.06 CLEANING AND PROTECTION
A. Remove spots, smears, stains, etc. , immediately with
material recommended by carpet manufacturer.
B. After installation, sweep and vacuum carpet surfaces
clean of all foreign material.
