RESOLUTION TO APPROVE LICENSE AGREEMENT WITH
BURLINGTON NORTHERN RAILROAD COMPANY FOR
WATER LINE UNDER RAILROAD RIGHT -OF -WAY
WHEREAS, the City needs to replace a water line under a
railroad and in the right -of -way owned by the Burlington Northern
Railroad Company; and,
WHEREAS, the Council has examined a proposed license
agreement with Burlington Northern Railroad Company to permit
installation of the water line.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The proposed license agreement between Burlington Northern
Railroad Company and the City of Wichita Falls for installation
of a 12" water line at Mile Pole 115.23 is hereby approved,
except for the provision that the City will indemnify the
railroad for damages arising out of the sole negligence of the
railroad. After this provision is deleted, the City Manager is
authorized to execute such license agreement for the City of
Wichita Falls.
