RESOLUTION TO ACCEPTING CONSTRUCTION AND
AUTHORIZING FINAL PAYMENT TO THE CONTRACTOR FOR
COMPLETION OF THE HARDING STREET BRIDGE PROJECT
WHEREAS, the City of Wichita Falls entered into a contract
dated November 30, 1987 for the Harding Street Bridge Project;
and,
WHEREAS, said project has been completed in accordance with
the plans and specifications 123 days past the contractual
completion date; and,
WHEREAS, said contractor has asked for a 21 day extension
due to unavoidable cause or causes beyond the contractor's
control; and,
WHEREAS, said contract was a unit price contract with a cost
of $686,265.17 of which the contractor has previously been paid
$617,638.65 leaving a balance due of $68,626.52; and,
WHEREAS, said contractor is being charged for 102 days of
liquidated damages at $100 per day the amount now due to the
contractor is $58,426.52.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The construction of said project is accepted by the City and
the City Manager is authorized and directed to pay the contractor
the amount as set out above.
