Res 022-89 2/7/1989RESOLUTION NO. ,, -1 RESOLUTION TO ACCEPTING CONSTRUCTION AND AUTHORIZING FINAL PAYMENT TO THE CONTRACTOR FOR COMPLETION OF THE HARDING STREET BRIDGE PROJECT WHEREAS, the City of Wichita Falls entered into a contract dated November 30, 1987 for the Harding Street Bridge Project; and, WHEREAS, said project has been completed in accordance with the plans and specifications 123 days past the contractual completion date; and, WHEREAS, said contractor has asked for a 21 day extension due to unavoidable cause or causes beyond the contractor's control; and, WHEREAS, said contract was a unit price contract with a cost of $686,265.17 of which the contractor has previously been paid $617,638.65 leaving a balance due of $68,626.52; and, WHEREAS, said contractor is being charged for 102 days of liquidated damages at $100 per day the amount now due to the contractor is $58,426.52. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The construction of said project is accepted by the City and the City Manager is authorized and directed to pay the contractor the amount as set out above. PASSED AND APPROVED THIS THE 7TH DAY OF FEBRUARY, 1989. ATTEST: CITY CLERK
