Ord 036-84 4/3/1984 ORDINANCE NO. d. �D— AN ORDINANCE CLOSING, VACATING, AND ABANDONING PORTIONS OF LINWOOD STREET AND SCOTLAND DRIVE, AND CERTAIN UTILITY AND DRAINAGE EASEMENTS IN SCOTLAND GARDENS ADDITION TO THE CITY OF WICHITA FALLS, TEXAS WHEREAS, the Planning Board has recommended that a portion of Linwood Street and Scotland Drive along with certain utility and drainage easements in the Scotland Gardens Addition be closed, vacated, and abandoned; and, WHEREAS, the City Council deems it advisable and in the public interest to close, vacate, and abandon the streets and easement hereafter described. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The portions of Linwood Street and Scotland Drive, and certain utility and drainage easements in Scotland Gardens Addition to the City of Wichita Falls, Texas, being more specifically being described as follows: A tract of land being a part of Linwood Avenue, a dedicated street, out of Scotland Gardens Addition, an addition to the City of Wichita Falls, said tract being further identified as lying within the J.A. Scott Survey No. 18, Wichita County, Texas, said tract being more specifically described by metes and bounds as follows: Beginning at a 2" iron rod located at the northwest corner of Lot 13, Block "B", of the above mentioned Scotland Gardens, said .," iron rod lying at the intersection of the south right-of-way line of Scotland Drive and the east right-of-way line of Linwood Avenue, said 2" iron rod being the north- east corner and place of beginning of this description; Thence South along the east right-of-way line of Linwood Avenue a distance of 305.0 feet to a 2" iron rod, said 1" rod lying in the east right-of-way line of Linwood Avenue, said 2" iron rod being the southeast corner of this tract; Thence West a distance of 39.00 feet to a z" iron rod, said 1" iron rod lying in the west right-of-way line of Linwood Avenue, said 2" iron rod also located at the northwest corner of Lot 11, Block "C", of the above mentioned 1 �� Scotland Gardens, said z iron rod being the southwest corner of this tract; Thence North along the west right-of-way line of Linwood Avenue a distance of 305.00 feet to a Z" iron rod, said 2" iron rod being the northwest corner of this tract; Thence East a distance of 39.00 feet to the place of beginning and con- taining 0.273 acres, more or less; -2- and A tract of land being a part of Scotland Drive, a dedicated street, out of Scotland Gardens Addition, an addition to the City of Wichita Falls, said tract being further identified as lying within the J.A. Scott Survey No. 18, Wichita County, Texas, said tract being more specifically described by metes and bounds as follows: Beginning at a 2" iron rod located at the southwest corner of Lot 15, Block "A" of the above mentioned Scotland Gardens Addition, said 2" iron rod lying at the intersection of the north right-of-way line of Scotland Drive and the east right-of-way line of Linwood Avenue, said 1" iron rod being the northwest corner and place of beginning of this description; Thence East along the north right-of-way line of Scotland Drive a distance of 367.00 feet to a 1/2" iron rod, said 2" iron rod lying in the west right-of-way line of U.S. Highway 287 Expressway, said 2" iron rod being the northeast corner of this tract; Thence along the west right-of-way of U.S. Highway 287 Expressway, South 61° 07' 21" East a distance of 103.53 feet to a Z" iron rod, said 1/2" iron rod lying at the intersection of the west right-of-way line of U.S. Highway 287 Expressway and the south right-of-way line of Scotland Drive, said II" iron rod being the southeast corner of this tract; Thence West along the south right-of-way line of Scotland Drive a distance of 457.66 feet to a 1/2" iron rod for corner, said l" iron rod lying in the south right-of-way line of Scotland Drive, said Z" iron rod being the southwest corner of this tract; Thence North a distance of 50.00 feet to the place of beginning and containing 0.473 acres, more or less; and A tract of land being a 35 foot drainage and utility easement out of Block "B" and "C", Tract No. Two and Block "D", Tract No. One of the Scotland Gardens Addition, an addition to the City of Wichita Falls, said tract being further identified as lying within the J.A. Scott Survey No. 18, Wichita County, Texas, said tract being more specifically described by metes and bounds as follows: Beginning at a point located at the southwest corner of Lot 14, Block "B", Tract No. Two of the above mentioned Scotland Gardens, said point lying in the east right-of-way line of Linwood Avenue, said point being the most westerly northwest corner of the herein described tract and the place of beginning of this description; Thence East a distance of 660 feet to a point for corner; Thence North a distance of 130.37 feet to a point, said point lying in the west right-of-way line of U.S. Highway 287 Expressway, said point being the most northerly northwest corner of this tract; Thence along the west right-of-way line of U.S. Highway 287 Freeway, South 53° 52' 47" East a distance of 49.52 feet to a point, said point being the north- east corner of this tract; t 1 -3- Thence South a distance of 136.18 feet to a point, said point being the southeast corner of this tract; Thence West a distance of 700.00 feet to a point, said point lying in the east right-of-way line of Linwood Avenue, said point being the southwest corner of said tract; Thence North along said east right-of-way line of Linwood Avenue, a distance of 35 feet to the place of beginning and containing 0.669 acres, more or less; and A ten (10) foot wide utility easement lying south of the north property line of Lot 1-A, Block 21, Scotland Gardens Addition to the City of Wichita Falls, Texas; be and the same are hereby closed, vacated and abandoned.
