ORDINANCE NO. 40-84
ORDINANCE WAIVING ORDINANCES CONCERNING CITY ENFORCEMENT OF
DEED RESTRICTIONS FOR LOT 1-A, BLOCK 81, FAITH VILLAGE UNIT
III, WICHITA FALLS, TEXAS
WHEREAS, a request has been made that the City waive those ordinances
concerning City enforcement of deed restrictions for Lot 1-A, Block 81, Faith
Village, Unit III; and,
WHEREAS, the City Council finds that the circumstances involved in this
situation are exceptional, and that a waiver of such ordinances should be granted
only in the event that the development and uses of such property shall be restricted
as hereinafter set out.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
Ordinances No. 3456, No. 3490, No. 3648, No. 3457, No. 3647 and No. 3699,
all of which relate to the enforcement by the City of deed restrictions, are
hereby waived insofar as they affect Lots 1-A, Block 81, Faith Village, Unit III,
an addition to the City of Wichita Falls, Texas, provided that the owners of such
properties shall subject such properties to the following restrictions:
1) A six (6) foot tall privacy fence must be constructed by the
developer along the portions of his property line abutting Lots
3-5, Blk 81, Faith Village, Unit III.
2) The proposed structure on this lot shall be of no more than one (1)
story with a maximum structure height of twenty (20) feet.
3) Any sign must face Kemp Blvd. and be no taller than the building.
4) All outdoor lighting must face Kemp Blvd.
5) The use of the structure shall be restricted to financial and profes-
sional office uses.
6) Access to and from the lot is to be solely on Kemp Blvd.
