ORDINANCE NO. h11.-41
AN ORDINANCE WAIVING ORDINANCES CONCERNING MUNICIPAL
ENFORCEMENT OF DEED RESTRICTIONS FOR TWO (2) LOTS IN
SOUTHLAND ADDITION, WICHITA FALLS, TEXAS
WHEREAS, the Planning Board has recommended that ordinances concerning
municipal enforcement of deed restrictions be waived for 1101 Brook Street and
1615 12th Street, both being located in the Southland Addition, Wichita Falls,
Texas; and,
WHEREAS, the City Council finds that the circumstances involved in these
situations are exceptional, and waivers of such ordinances should be granted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
Ordinances No. 3546, No. 3490, No. 3648, No. 3457, No. 3647 and No. 3699,
all of which relate to the enforcement by the City of deed restrictions, are hereby
waived insofar as they affect the properties further described as follows:
1. The West of Lots 12, 13, & 14, Blk 5, Southland Addition (1101 Brook St.)
and,
2. Being a part of Lots Thirteen (13) and Fourteen (14) in Block No. One (1)
of the Southland Addition, an Addition to the City of Wichita Falls,
Wichita County, Texas (1615 12th Street) :
BEGINNING at the SE corner of Lot 13;
THENCE North along the West alley line of said Block 1, 81.8 feet to a
stake for corner;
THENCE North 12° 30' W, 29 feet to a cross mark cut in concrete driveway
in the South line of Twelfth Street, the same being a point in the North-
westerly line of said Lot 14;
THENCE Southwesterly on the Southerly line of Twelfth Street, the same
being the Northwesterly line of said Lot 14, 64 feet to a stake for corner;
THENCE Southeasterly at right angles to Twelfth Street, and the North-
westerly border line of said Lot 14, 88.7 feet to a cross mark on tip of
fence in South line of said Lot 13;
THENCE East on the South line of Lot 13, 8 feet to the place of beginning.
