Ord 076-84 7/3/1984 ORDINANCE NO. 7Cp--d ORDINANCE TO REPEAL SECTIONS 32-36, AND 32-43 OF THE CODE OF ORDINANCES; AND TO INITIATE A NEW ORDINANCE TO PROHIBIT CERTAIN ACTIONS IN AND AROUND THE PUBLIC UTILITY WATER FACILITIES WHEREAS, Sections 32-36 and 32-43 of the Code of Ordinances require update; and WHEREAS, it is deemed necessary to protect the public water supply and system and provide for the public safety. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Section 32-43 is repealed in its entirety. Section 32-36 is changed to read as follows: "Sec. 32-36. Prohibition of certain acts in, on, and around public water facilities. In the interest of the public safety and to protect the public water system from damage or contamination, the following described acts are declared unlawful. (a) Any unauthorized access onto or damage to any elevated, ground, or underground water storage tank. (b) Any unauthorized entry into or damage to a fenced or housed facility belonging to the Public Utilities Department or to any Public Utility area specifically marked to deny uncontrolled entry or use. (c) Fishing, swimming, bathing, wading or throwing trash or foreign substances into any lake, reservoir, canal, tank, basin or other water containing facilities of the Public Utilities Department, except as provided in Article III of Section 22 of the Code of Ordinances".
