Ord 077-84 7/3/1984 • ORDINANCE NO. 77—TV ORDINANCE TO AMEND SECTION 10(E) OF APPENDIX A (COMPREHENSIVE SUBDIVISION ORDINANCE) OF THE CODE OF ORDINANCES TO REQUIRE PRO-RATA CHARGES FOR A SUBDIVISION TO MAKE A DIRECT CONNECTION TO AN OFF-SITE UTILITY LINE WHICH THE CITY HAS FINANCED WHEREAS, the City finances the installation of water and sewer lines in various locations using proceeds of the Water and Sewer Fund for the investment; WHEREAS, the Subdivision Ordinance in Section 10(E) provides for recovery of the city investment for water and sewer lines that lie within or abut a subdivision; WHEREAS, a newly-developed subdivision may be connected direct to an off-site line which the city has financed, and thereby consume a portion of the available capacity of said lines; WHEREAS, the current ordinance does not specify that a portion of the city investment may be recovered for existing off-site lines; and, WHEREAS, it is proper for costs-of-service to be assessed as nearly as possible to those who use the particular service. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Section 10(E) of Appendix A (Comprehensive Subdivision Ordinance) of the Code of Ordinances is amended to read as follows : " (E) Where an existing water or sewer line lies within or abuts the subdivision, the subdivider shall make no connections to or extension of such existing line without first paying to the city the cost of the size line of equal length to that portion of such existing line which lies within or abuts the subdivision which would be required to serve the subdivision. Where the subdivision is to be connected directly to an existing off-site water or sewer line which has been installed at city expense, the subdivider shall first pay to the city a pro-rata share of the city investment to install said line. The pro-rata charge shall be based on the proportion of the total line capacity to be consumed by the subdivision, and shall be in addition to other off-site improvements required by this ordinance to properly serve the subdivision. Where there is an option to connect the subdivision either to charge or one on which there is no charge, which there is a pro-rata g , a line on p the professional judgment of the Director of Public Works/Utilities shall prevail in the decision. The costs addressed by this paragraph shall be determined by the Department of Public Works/Utilities, and his decision shall be final."
