AN ORDINANCE WAIVING ORDINANCES CONCERNING MUNICIPAL ENFORCEMENT
OF DEED RESTRICTIONS FOR 4605 PASADENA, NAMELY, LOT 3 AND THE EAST
TEN (10) FEET OF LOT 4, BLOCK 122, WESTMORELAND PARK AND ADJACENT
PROPERTIES, WICHITA FALLS, TEXAS
WHEREAS, the Planning Board has recommended that ordinances concerning
municipal enforcement of deed restrictions be waived for 4605 Pasadena, namely,
Lot 3 and the east ten (10) feet of Lot 4, Block 122, Westmoreland Park and Adjacent
Properties, Wichita Falls, Texas; and,
WHEREAS, the City Council finds that the circumstances involved in this
situation is exceptional, and waivers of such ordinances should be granted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
Ordinances No. 3546, No. 3490, No. 3648, No. 3457, No. 3647 and No. 3699,
all of which relate to the enforcement by the City of deed restrictions are hereby
waived for the establishment of a ten (10) by fourteen (14) feet kitchen for a
catering barbecue business, insofar as they affect 4605 Pasadena, namely Lot 3 and
the east ten (10) feet of Lot 4, Block 122, Westmoreland Park and Adjacent
Properties, Wichita Falls, Texas.
